For Non-applicant : Mr. Kanwaljeet Singh Saini, Dy. G.A.
Hon’ble Shri Justice Rakesh Mohan Pandey
Order on Board
04/11/2026
1. As all these are the first bail applications under Section 483 of Bharatiya
Nagarik Suraksha Sanhita, 2023 preferred by the same applicant arise out
of different crime numbers i.e. Crime Nos. 186/2026; 294/2025 & 182/2026
registered at Police Station- Khamhardih, District Raipur (CG) for
commission of offence punishable under Sections 303(2), 317(2) and 3(5)
of BNS, therefore, they are being disposed of by this common order.
2. As per case of prosecution, an F.I.R. was lodged by Balram Sundrani on
09.12.2025 with regard to theft of his scooty making statement that his
scooty was stolen by some unknown person on 04.12.2025. The said F.I.R.
was registered against unknown person. Subsequently 05 other F.I.Rs.
were registered against unknown person, wherein allegation of commission
of theft was made. The the present applicant was taken into custody on
03.07.2026 and on the basis of his memorandum, the applicant was made
accused in 06 other cases.
3. Learned Advocate appearing for the applicant would argue that though
there are 03 criminal antecedents of the applicant, but he was made an
accused in all those cases on the basis of his memorandum. It is also
contended that Crime Nos. 792/2025, 529/2025 and 08/2026 have already
been disposed of on account of compromise. He would submit that the
applicant has approached this Court for grant of bail in connection with
Crime Nos. 186/2026; 294/2025 & 182/2026. He would further submit that
in all these crime numbers, charge-sheet have already been filed, the

3
applicant was formally arrested on 03.07.2026 in these cases and is in jail
since 16.06.2026, therefore, the applicant may be granted bail in these bail
applications.
4. On the other hand, Mr. Kawal Jeet Singh Saini, learned Deputy
Government Advocate appearing for the State/non-applicant would submit
that there are 06 criminal antecedents of the applicant, therefore, these bail
applications deserve to be rejected. It is also argued that nothing was
recovered on the instance of the present applicant.
5. I have heard learned counsel for the parties and perused the case diary.
6. Having considered the fact that on 03.07.2026, the applicant was taken into
custody and on the basis of his memorandum, he was made accused in 06
other cases making allegation that he committed theft; further Crime Nos.
792/2025, 529/2025 and 08/2026 have already been disposed of on
account of compromise, nothing was recovered on the instance of the
applicant, charge-sheet has already been filed and he is in jail from
03.07.2026, therefore, I am inclined to allow these bail applications.
Accordingly, all the bail applications are allowed.
7. It is directed that, in the event of the applicant executing a personal bond
for a sum of Rs. 50,000/- in each case, with one surety each in the like
amount to the satisfaction of the concerned Trial Court, the applicant shall
be released on bail subject to the following conditions :-
(I) he shall not directly or indirectly make any inducement,
threat or promise to any person acquainted with the facts of
the case so as to dissuade him from disclosing such fact to
the Court,
(ii) he shall not act in any manner which will be prejudicial to
fair and expeditious trial, and
(iii) he shall appear before the trial Court on each and every

4
date given to him by the said Court till disposal of the trial.
The observation made hereinabove is for the purpose of deciding this
bail application only, the trial Court shall decide the case on its own
merits.
