Writ Petition filed under Article 226 of the Constitution of India issuing
writ of mandamus directing the Respondents 1 to 8, to consider and act
upon the petitioner representation dated 13.06.2026 and in accordance
with law and after following due process, to conduct a proper survey and
demarcation of the public cart track/public pathway comprised in Survey
Nos.20/2, 13/1, 13/2, 13/5, 23/3, 23/4, 12/5, 12/8, 12/9 and 12/12
situated at Thagamtheerthapuram Village and Survey Nos.201/5 and
202/1 situated at Poondi Village, Chinnasalem Taluk, Kallakurichi
District, to identify and remove the encroachments made by the private
respondents 9 to 13 and any other persons, and consequently restore
the public pathway to its original recorded width, within a time frame
fixed by this Court.

ORDER
(Order of the Court was made by S.M.Subramaniam J.)
The present writ petition has been instituted to direct the
respondents 1 to 8 to act upon the petitioner’s representation dated
13.06.2026 and in accordance with law and after following due process,
to conduct a proper survey and demarcation of the public cart
track/public pathway comprised in Survey Nos.20/2, 13/1, 13/2, 13/5,
23/3, 23/4, 12/5, 12/8, 12/9 and 12/12 situated at Thagamtheerthapuram
Village and Survey Nos.201/5 and 202/1 situated at Poondi Village,
Chinnasalem Taluk, Kallakurichi District, to identify and remove the
encroachments made by the private respondents 9 to 13 and any other
persons, and consequently restore the public pathway to its original
recorded width.
2. With reference to the relief sought for in the present writ
petition, the learned Special Government Pleader, based on the written
instructions given by the Revenue Tahsildar by proceedings dated
02.11.2026, would submit that survey was conducted, encroachers
identified and enforcement action has been initiated for removal of
encroachments.

3. In this regard, Form I notice has already been issued and
Block Development Officer has to initiate appropriate action for removal
of encroachments under the provisions of the Act and rules.
4. In view of the said position, respondents 3 and 4 are
directed to initiate enforcement action by following the procedures as
contemplated under the relevant statutes and rules in force, and by
affording opportunity to the encroachers, and thereafter remove the
encroachments identified. The entire exercise is directed to be
completed within a period of twelve weeks from the date of receipt of a
copy of this order.
5. With the above directions, the writ petition stands disposed
of. No costs. Consequently, the connected miscellaneous petitions, if
any, are closed.
