Order on Board
28/10/2026
1. These criminal revisions have been preferred by the
applicants/juveniles under Section 102 of the Juvenile Justice (Care
2
and Protection of Children) Act, 2015 (hereinafter referred to as the ‘JJ
Act’), challenging the impugned orders dated 15.06.2026 and
11.06.2026 passed by the learned Upper Sessions Judge (FTC),
District Janjgir-Champa (C.G.), in Criminal Appeal Nos. 63/2026 and
62/2026, respectively, whereby the appeals preferred by the
applicants/juveniles have been rejected, upholding the order dated
04.06.2026 passed by the learned Principal Magistrate, Juvenile
Justice Board, Janjgir, District Janjgir-Champa, in Crime No. 58/2026,
whereby their bail applications under Section 12 of the JJ Act were
rejected.
2. Facts of the case, in brief, are that the sister of Manish Chauhan, who
is said to be the main accused, was in a relationship with the
deceased, Rahul Chauhan. On account of this relationship, Manish
Chauhan, along with four other adult accused persons and four
juveniles, including the applicants in both cases, allegedly committed
the murder of the deceased, Rahul Chauhan. Therefore, an FIR was
registered, and after completion of the investigation, a charge-sheet
for the offences under Sections 103(1) and 61(2) of the Bharatiya
Nyaya Sanhita, 2023, was filed against all the accused persons. A
supplementary charge-sheet was filed against the five
juveniles/accused persons before the Juvenile Justice Board, Janjgir-
Champa, which is pending consideration. The bail applications filed by
both applicants/juveniles under Section 12 of the JJ Act were rejected
by the Juvenile Justice Board, Janjgir-Champa, vide order dated
04.06.2026. Thereafter, the appeals preferred by them were also
rejected vide the impugned orders dated 15.06.2026 and 11.06.2026,
3
respectively, by the learned Upper Sessions Judge (FTC), Janjgir-
Champa (C.G.). Hence, these criminal revisions.
3. Learned counsel for the applicants/juveniles would submit that both
applicants/juveniles have been in the Observation Home since
12.02.2026. This is the first conflict with law involving the
applicants/juveniles. They have been implicated only because they are
friends of the main accused, Manish Chauhan. They have not played
any role in the alleged offence. It is further submitted that keeping
them in the Observation Home for a further period may adversely
affect their childhood, conduct, and behaviour. Hence, it is prayed that
the orders passed by the learned Appellate Court as well as the
learned Juvenile Justice Board be set aside and both
applicants/juveniles be enlarged on bail.
4. Per contra, learned State counsel opposes the bail applications of the
applicants/juveniles and submits that both applicants/juveniles also
accompanied the main accused, Manish Chauhan, along with the
other accused persons, in committing the murder of the deceased.
Therefore, the revisions may be rejected.
5. Heard learned counsel for the parties and perused the material
available on record, along with the case diary.
6. As contended by learned counsel appearing for the respective
applicants/juveniles, they have been in the Observation Home since
12.02.2026. As per the social status reports, this is the first conflict
with law involving the applicants/juveniles. Their conduct and
behaviour in the Observation Home have been stated to be good. As
per the case diary, they have not played an active role in committing
4
the alleged offence. Nothing has been brought on record by the
prosecution to demonstrate the fact that, if released on bail, the
applicants/juveniles are likely to come into association with any known
criminal or be exposed to any moral, physical, or psychological
danger. Considering the aforesaid circumstances, this Court is inclined
to allow the present revisions.
7. Accordingly, the present criminal revisions are allowed . The impugned
orders dated 15.06.2026 and 11.06.2026, respectively, passed by the
learned Upper Sessions Judge (FTC), Janjgir-Champa, as well as the
order dated 04.06.2026 passed by the learned Principal Magistrate,
Juvenile Justice Board, Janjgir, District Janjgir-Champa, are hereby
set aside.
8. It is directed that, if the mother or father of each applicant/juvenile
furnishes a personal bail bond of Rs. 25,000/- along with one surety in
the like amount to the satisfaction of the Juvenile Justice Board,
Janjgir-Champa, undertaking to ensure the appearance of the
respective applicant/juvenile before the Board as and when directed,
the applicants/juveniles shall be released into the custody of their
respective parents.
