ORDER
(Order of the Court was made by
G.Arul Murugan,J)
The review application has been filed seeking to review the
order dated 16.02.2026 made in W.A.No.325 of 2026.
2. Petitioner-in-person contended that when the fact remains
that he has not sought No Objection Certificate for obtaining

educational loan for his children education, but only wanted to avail
benefits from the employer in respect of education of his children,
the facts have been wrongly noted in the order and therefore, seeks
review of the order.
3. We have heard petitioner-in-person and perused the
materials on record.
4. Petitioner had originally filed W.P.No.49810 of 2025,
assailing the order dated 22.09.2025 passed by the Chief
Educational Officer, Thanjavur. The learned Single Judge, recording
that after exhausting the regular battlefields, the warring petitioner
and wife are dragging all the educational authorities, corporation
authorities and revenue authorities and also occupying the writ
Court which resulted in the docket multiplication which has gone
beyond 15 cases and also taking note of the fact that already
petitioner has filed a custody application, which was pending before
the competent Court where the guardianship and matrimonial
issues are pending, observed that the issue could be addressed in

the said competent Court and dismissed the writ petition imposing
cost of Rs.2,000/- on petitioner.
5. Assailing the order of the learned Single Judge, petitioner
filed W.A.No.325 of 2026. This Court, finding that since the writ
petition was dismissed considering several litigations between
petitioner and his wife on various matrimonial issues, including
custody of children, dismissed the writ appeal for want of valid
ground to interfere with the order passed by the learned Single
Judge.
6. Now the sole ground raised by petitioner to review the
order is that it has been wrongly recorded that petitioner intended
to obtain educational loan for his children, when the fact remains
that he only wanted to avail benefits from the employer, for which,
he required a bona fide certificate. The issue was considered by the
learned Single Judge and also by this Court in the writ appeal,
where, after taking note of several litigations between the petitioner
and his wife and finding that there is also multiplicity of proceedings

and that the child is in the custody of mother and an application
was filed by petitioner seeking custody of the child, liberty was
given to raise all the issues in the pending suit.
7. In our considered opinion, the ground raised to review the
order does not come within the purview of Order XVII, Rule 1, Code
of Civil Procedure, as the review can be made strictly within the
parameters stated in the aforesaid provision. It is well settled by
1
the Hon’ble Supreme Court in Malleeswari v. K.Suguna that review
court does not sit in appeal over its own order and a rehearing of
the matter is impermissible.
8. In view of the aforesaid, the review application is
dismissed.
