Order on Board
29.10.2026
1. This is the First bail application filed under Section 483 of the
Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail
to the applicant who has been arrested in connection with Crime
No. 04/2024 registered at Cyber Police Station, District : Bilaspur
(C.G.) for the offence punishable under Sections 420, 34, 109 and
201 of Indian Penal Code and Section 66-D of Information and
Technology Act.
2
The prosecution story in brief is that the complainant lodged a
2.
written report on 20.06.2024 to the effect that, between
06.06.2024 and 13.06.2024, the holder of mobile No. 8179093754
and WhatsApp No. 9043932735 added him to various WhatsApp
and Telegram groups on the pretext of earning money by
submitting reviews, and thereafter induced him to engage in
online trading through the CoinDCX platform. The complainant
deposited Rs. 25,60,257/- into various bank accounts with Federal
Bank and DBS Bank from his own and his father’s SBI accounts.
When the money so deposited was not refunded, he lodged an
FIR. During the course of investigation, one Sadanand Mahant
was arrested, who implicated the present applicant in the case.
Learned counsel for the applicant submits that the applicant has
3.
not personally obtained any monetary benefit, or other advantage
through the alleged cyber fraud, and that he has no acquaintance
or connection whatsoever with the co-accused persons. He
further submits that the charge-sheet has been filed, the applicant
has no criminal antecedents but he is languishing in jail since
19.03.2026, and the conclusion of the trial may take some time;
therefore, he prays for the grant of regular bail to the present
applicant.
On the other hand, the learned State counsel opposes the bail
4.
application of the present applicant and submits that the applicant
is involved in cyber fraud and managed the various account
3
holders through whom huge sums were siphoned in the said
fraud; therefore, he is not entitled to be released on bail.
5. I have heard learned counsel for the parties and perused the case
diary.
It appears that the complaint regarding cyber fraud was lodged on
6.
20.06.2024. During the course of the investigation, one Sadanand
Mahant was taken into custody, who implicated the present
applicant by outlining his alleged role in the offence. However, no
financial benefit has been attributed to the applicant, and he has
no criminal antecedents. Moreover, as the charge-sheet has
already been filed, the applicant has been in custody since
19.03.2026, and no further custodial interrogation is required, this
Court is of the view that the applicant deserves to be enlarged on
bail. Accordingly, this bail application is allowed.
7. It is directed that in the event of the applicant executing a personal
bond for a sum of Rs. 50,000/- to the satisfaction of the concerned
trial Court, he shall be released on bail on the following
conditions:-
(a) he shall make himself available for interrogation
by the police officer as and when required;
(b)he shall not directly or indirectly make any
inducement, threat or promise to any person
acquainted with the facts of the case so as to
dissuade him from disclosing such fact to the
Court; and
4
(c) he shall not act in any manner which will be
prejudicial to a fair and expeditious trial.
The observation made hereinabove is for the purpose of
deciding this bail application only, the learned trial Court shall
decide the case on its own merits.
