ORAL ORDER
Accused Nos.2 & 3 in crime No.154/2026 registered
by Channammanakere Achukattu Police Station, Bengaluru
for offences punishable under Section 310(2) and Section
351(2) of BNS, 2023 are before this Court in these two
petitions filed under Section 483 of BNSS, 2023 seeking
regular bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.154/2026 was registered by
Channammanakere Achukattu Police Station for the
aforesaid offences against Deepak and others, based on
the first information dated 20.08.2026 received from
Gopikrishna who is alleged victim in the present case.
During the course of investigation, petitioners herein
arrayed as accused Nos.2 and 3 in the FIR were arrested
on 22.08.2026 and remanded to judicial custody. Their

bail application filed before the Jurisdictional Sessions
Court was rejected and therefore they are before this
Court in these two petitions.
5. A reading of the first information dated
20.08.2026 submitted by the alleged victim would go to
show that accused No.1/Deepak is the childhood friend of
the first informant and even the other accused persons are
all acquainted to him. On 16.08.2026, at about 7.30 p.m.,
when the first informant was returning home in his scooter
accused persons intercepted his scooter and thereafter
allegedly quarrelled with him and assaulted him with
hands. He has stated that as per the demand of the
accused persons he had transferred an amount of
Rs.15,000/- through phone-pay to the account of accused
No.2/Dhanush. He has further alleged that thereafter, the
accused persons had criminally intimidated him and had
left the said spot.
6. In respect of the alleged incident that had taken
place on 16.08.2026 first information is submitted

belatedly on 20.08.2026, which is after a period of four
days. Proper explanation for the inordinate delay is not
found in the first information.
7. Undisputedly the accused persons are all friends to
the first informant. Learned counsel for the petitioner has
filed a memo along with certain documents contending
that accused No.2 has repaid an amount of Rs.13,000/- to
the first informant out of Rs.15,000/- which was
transferred to his bank account, even prior to the FIR
being registered. It is brought to the notice of this Court
that accused Nos.1, 4 and 5 have been already granted
regular bail in the present case by the Jurisdictional
Sessions Court.
8. Learned High Court Government Pleader has
brought to the notice of this Court that petitioners are
persons with criminal antecedents. Under these
circumstances, the following:

O R D E R
The Criminal Petitions are allowed . The petitioners
are directed to be enlarged on bail in Crime No.154/2026
registered by Channammanakere Achukattu Police Station,
for the offences punishable under Section 310(2) and
Section 351(2) of BNS, 2023 , subject to the following
conditions:
a) Petitioners shall execute personal bond for
a sum of Rs.1,00,000/- with two sureties for
the likesum, to the satisfaction of the
jurisdictional Court;
b) The petitioners shall appear regularly on
all the dates of hearing before the Trial Court
unless the Trial Court exempts his appearance
for valid reasons;
c) The petitioners shall not directly or
indirectly threaten or tamper with the
prosecution witnesses;
d) The petitioners shall not involve in similar
offences in future;
e) The petitioners shall not leave the
jurisdiction of the Trial Court without
permission of the said Court until the case
registered against him is disposed off.

f) Petitioners are directed to appear before the
Station House Officer of Channammanakere
Achukattu Police Station on every 1st Sunday
and 3rd Sunday of the month between 10.00
a.m. and 1.00 p.m and mark their attendance
regularly till investigation of the case is
completed and charge sheet is filed.
