COMMON JUDGMENT
These Criminal Appeals are directed against the orders dated
27.08.2026 and 10.09.2026 passed by the III Additional District and
Sessions Court (P.C.R.), Madurai, declining bail to the
petitioners/appellants in Crl.M.P. Nos. 386 and 423 of 2026, respectively.
2. The learned counsel appearing for the appellants submitted that
there was a wordy quarrel between the accused and the victims and few
hours thereafter, the victim had committed suicide by hanging. He
further alleged that the deceased had committed suicide only due to a
quarrel with his mother, for which they have been falsely implicated.
3. On the other hand, the learned Public Prosecutor appearing for
the respondent police submitted that the investigation has been completed
and the final report has already been filed before the jurisdictional Court.
The case has been taken on file as Spl.S.C.No.103 of 2026 on the file of
the III Additional District Court for PCR Cases, Madurai. He further
brought to the notice of this Court that the appellant in Crl.A.(MD)
No.1179 of 2026 has no previous criminal antecedents. However, the

petitioner in Crl.A.(MD) No.1220 of 2026, who is arrayed as Accused
No.3 in the said case, has two previous cases registered against him,
namely, Crime No.273 of 2023 on the file of the Tirumangalam Town
Police Station, for the offences punishable under Sections 147, 148,
294(b), 323, 326 and 506(ii) of the IPC, read with Sections 3(1)(s) and
3(2)(v) of the SC/ST Act, and Crime No.432 of 2025, for the offences
punishable under Section 8(c) read with Section 20(b)(ii) of the NDPS
Act. Therefore, he strongly opposed the grant of bail on the ground that
the threat to the other victims continues to persist.
4. Today, when the matters are taken up for hearing, the third
respondent appeared in person and opposed the grant of bail on the
ground that, if the appellants are released on bail, they would pose a
threat to her life.
5 . This Court has given its thoughtful consideration to the rival
submissions put forth by either side.
6. Considering the fact that the appellant in Crl.A.(MD) No.1179 of
2026 has been in judicial custody for the past 86 days and the appellant in
the connected appeal has been in judicial custody for the past 61 days,
