1. Applicants have preferred first bail application filed under Section
482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short
2
‘BNSS’) for grant of anticipatory bail to the applicants who are
apprehending their arrest in connection with Crime No. 88/2026
registered at Police Station – Mahila Thana, Durg District – Durg
(C.G.) under Sections 85, 91, 318(4), 115(2), 316, 296, 3(5) of
B.N.S and Section 4 of Dowry Prohibition Act, 1961.
2. The case of the prosecution in brief is that the marriage between
complainant Smt. Diksha Chaturvedi (Shukla) and Ravi Shukla
solemnized on 19.01.2025. The allegation against the applicants
is that the applicants who are father-in-law and mother-in-law of
the complainant, along with their son Ravi Shukla induced the
complainant's family into marriage by misrepresenting educational
qualifications and employment of her husband, and extracted
cash and other articles during wedding ceremonies. Shortly after
marriage, the applicants and their son in lieu of demand of dowry
subjected the complainant to physical and mental cruelty.
3. Learned counsel for applicants would submit that baseless
allegation have been levelled against the applicants of harassing
the complainant with regard to demand of dowry. The applicants
are old aged father-in-law and mother-in-law, they have been
falsely implicated in this case. He also submits that applicant No.1
is professor of Sanskrit and HOD in the CMD, College, Bilaspur.
Applicant No.2 is mother in law of the complainant. He also
contended that the marriage of their son performed with the
complainant on 19.01.2025 and thereafter, the complainant find
3
herself difficult to adjust in the family, thereafter the false report
has been lodged. Hence, the benefit of anticipatory bail may be
extended to them.
4. Learned State counsel opposes the submission of learned
counsel for applicants. He submits that there is specific allegation
against the applicants harassing, abusing and also assaulting the
complainant for want of dowry. He also submits that there is
allegation that due to the said assault the complainant suffered
miscarriage. It is contended that some photographs have been
filed to support that prior to filing of the complaint, the complainant
was treated with cruelty. He also pointed out there is transfer of
Rs.11,50,000/- in cash to applicant No.1/father in law and
Rs.10,00,000/- in the account of applicant No.2/mother in law.
When specific question is posed with regard to date of transfer of
said money, he submitted that from the date it appears that the
said transaction was made at the time of marriage.
5. Learned counsel for the objector would also oppose the
submission of learned counsel for applicants and submits that the
applicants along with the co-accused has projected their son to be
working in the multinational company and thereby they have
succeeded in making relationship with the complainant family. He
also submits that from the date of marriage the complainant was
harassed and also assaulted due to which she suffered
4
miscarriage and thereby the applicants have actively participated
in commission of offence.
6. I have heard learned counsel for the respective parties and
perused the documents placed on record.
7. Taking into consideration the facts and circumstances of the case,
the nature of allegation, submission made by learned counsel for
respective parties and further considering the date of marriage
and also that the applicant No.1 is aged about 64 years and is
professor of Sanskrit as submitted by counsel for the applicants
that he is HOD in the CMD, College, Bilaspur. Applicant No.2 is
mother-in-law of the complainant, without commenting anything
on merits of the case, I am inclined to allow this anticipatory bail
application.
8. Accordingly, the anticipatory bail application is allowed and it is
directed that in the event of arrest of applicants in connection with
the aforementioned crime number, they shall be released on
anticipatory bail by the Officer arresting them on executing a
personal bond in the sum of ₹25,000/- with one surety each in the
like sum to the satisfaction of the concerned arresting Officer.
Applicant shall also abide by the following conditions:
(i) that the applicants shall make themselves available for
interrogation before the Investigation Officer as
and when required;
(ii) that the applicants shall not, directly or indirectly, make
any inducement, threat or promise to any person
acquainted with the facts of the case so as to dissuade
5
him/her from disclosing such facts to the Court or to any
police officer;
(iii) that the applicants shall not act, in any manner, which
will be prejudicial to fair and expeditious trial; and
(iv) that the applicants shall appear before the trial Court
