in this matter merely for the reason that she was working as Section Officer
in the Cash Branch of Netaji Subhash Chandra Bose Government Medical
College, Jabalpur. Learned counsel submits that the applicant is a
compassionate appointee after demise of her husband. She was not aware of
operation of Tally Software. Co-accused Arvind used to make entry into the
Tally Software. Learned counsel also submits that the account of Cash
Section was annually audited by a Chartered Accountant. He never reported
financial irregularities. The matter relates to verification of account. Learned
counsel also submits that during internal enquiry, it was found that co-
accused Vishal Sarathe has deposited Rs.2 Crores more against the cash
received by him. It shows that the matter relates only to mistake in the
accounting. Learned counsel also submits that all the co-accused have been
extended benefit of bail. No money trail was found nor consequent
recoveries were made during investigation to show wrongful gain by any of
the co-accused. The applicant is ready to cooperate in the investigation. The
applicant is aged around 45 years. She is a widow having responsibility of
two children. There is no likelihood from fleeing from justice or tempering
with evidence already seized. On these grounds, it is prayed that applicant be
released on anticipatory bail.

Section, therefore, FIR was registered against her. The investigation is
underway relating to verification of cash receipts and account statements.
The other co-accused have been extended benefit of regular bail whereas the
applicant has applied for anticipatory bail. She did not cooperate in the
investigation. Considering the gravity of alleged offence, the applicant may
not be extended benefit of anticipatory bail as her custodial interrogation
would be needed. However, after going through the case diary, learned
counsel for the State submits that no criminal antecedent is reported against
the applicant.
6. As per the accusation on case diary, the applicant, who was
Section Officer at Netaji Subhash Chandra Bose Government Medical
College, Jabalpur had committed criminal misappropriation of the amount
received in cash section of the Medical College. An internal enquiry
Committee was constituted which reported missing amount to approx.
Rs.4,00,00,000/- during working of the applicant in the Cash Section. The
allegation against applicant relates to financial irregularity by non-deposit of
the received amount in Bank. The investigation is underway. All co-accused
have been extended benefit of regular bail. Applicant is apprehending her
arrest in the matter. The trial would take time to conclude. The prosecution is
based on verification of accounts. The material documentary evidence is
already seized. The veracity of the prosecution will be considered on merit
after evidence.
7. As informed, the applicant is a widow aged around 45 years and has
responsibility of two children. She was working as compassionate appointee.

Considering the age and status of the applicant, there appears to be no
likelihood of fleeing from justice or involving in any criminal activity.
Considering the socio-economic status of the applicant, there appears to be
no likelihood of tampering with the evidence, influencing the witness or
interfering in the investigation by the applicant. The incarceration of
applicant does not appear to be necessary for the purpose of investigation.
The grant of anticipatory bail to the applicant will not cause prejudice to free,
fair and full investigation. Considering her age and family and social status,
the applicant may suffer hardship and prejudice due to incarceration entailing
social disrepute and humiliation. Considering the overall circumstances of
the case, but without commenting on merits of the accusation, this Court is
inclined to grant anticipatory bail to the applicant. Thus, the application is
allowed.
8. Accordingly, it is directed that in the event of arrest of applicant -
Sadhana shall be released on bail in connection with Crime number as
mentioned in the first paragraph of this order, upon furnishing a personal
