1. Applicants have preferred first bail application filed under Section
482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short
2
‘BNSS’) for grant of anticipatory bail to the applicants who are
apprehending their arrest in connection with Crime No. 1164/2026
registered at Police Station – Civil Line, District – Bilaspur (C.G.)
under Sections 115(2), 296, 351(3), 74 and 3(5) of B.N.S.
2. As per case of the prosecution, complainant had lodged a report
against the accused persons in the police station to the effect that
the complainant has been working in 36 City Mall Ekka Wellness
Spa Centre for about 03 months. Applicant No.2/Aman Sen, the
operator of Ekka Wellness Spa Center, and his elder brother,
Applicant No.1/Lokesh Sen, used to force her to have a spa done
at their place. Applicants would take her to their private cabin and
touch her cheeks and hands, which she had refused several
times. Despite asking her to leave job, she was not paid her
previous month's salary. On August 25, 2026, she went to collect
her salary, she met the accused. Applicant No.1/Lokesh Sen.
When she asked for her previous month's salary, he said, "You
want to defame his brother," and with the intention of molesting
her, he forcibly touched her body. When she tried to make a video
by freeing her hand, he snatched her mobile phone and put it in
his pocket and started abusing her with filthy words. When she
asked not to abuse her, he punched her and twisted her right
hand.
3. Learned counsel for applicants submits that applicants are
innocent and they have been falsely implicated in this case. He
submits that complainant was employee of the applicants who are
3
running Spa Center at 36 City Mall Ekka Wellness Spa Centre,
Bilaspur. He contended that complainant was fired from the job
because of non satisfactory service and thereafter false allegation
has been alleged. He submits that there is no other criminal
antecedent registered against the applicants.
4. Learned State counsel opposes the submission of learned
counsel for applicants. He submits that according to the material
available in case diary it is appearing that earlier the applicant
No.2 had touched inappropriately to the complainant and
thereafter when complainant went to Spa Center on 25.08.2026
and demanded arrears of the salary at that time, the applicant
No.1 also misbehaved and touched inappropriately, assaulted her.
She do not dispute the submission of learned counsel for the
applicants that there is no other criminal antecedent registered
against the applicants.
5. I have heard learned counsel for parties and perused the
documents placed on record.
6. Taking into consideration the facts and circumstances of the case,
the nature of allegation, submission made by learned counsel for
respective parties and also considering that there is no other
criminal antecedent registered against the applicants, without
commenting anything on merits of the case, I am inclined to
release the applicants on anticipatory bail.
7. Accordingly, the anticipatory bail application is allowed and it is
directed that in the event of arrest of applicants in connection with
4
the aforementioned crime number, they shall be released on
anticipatory bail by the Officer arresting them on executing a
personal bond in the sum of ₹25,000/- with one surety each in the
like sum to the satisfaction of the concerned arresting Officer.
Applicant shall also abide by the following conditions:
(i) that the applicants shall make themselves available for
interrogation before the Investigation Officer as
and when required;
(ii) that the applicants shall not, directly or indirectly, make
any inducement, threat or promise to any person
acquainted with the facts of the case so as to dissuade
him/her from disclosing such facts to the Court or to any
police officer;
(iii) that the applicants shall not act, in any manner, which
will be prejudicial to fair and expeditious trial; and
