2. Ms.G.Dhana Madhri, learned Special Government Pleader, takes notice
on behalf of the respondent.
3. By consent of the parties, the main writ petitions are taken up for
disposal at the admission stage itself.
4. The learned counsel for the petitioner would submit that in these cases,
initially, the show cause notice were issued by the respondents on 25.09.2025 &
11.06.2025. Subsequently, vide communications dated 20.11.2025 &
23.09.2025, the petitioner sought time for filing the replies. However, without
granting any such time, the assessment orders dated 24.12.2025 came to be
st
passed by the 1 respondent. Aggrieved over the said assessment orders, the
petitioner filed the appeals on 30.04.2026 & 06.05.2026 with a delay of 6 days
and 12 days, respectively, beyond the condonable period. According to the
petitioner, the said delay had occurred only due to the fault of the part of the
petitioner’s consultant. Since the said delay is beyond the condonable period,
nd
the appeal was rejected by the 2 respondent, vide impugned rejection orders
dated 26.05.2026 & 08.06.2026, on the aspect of limitation. Hence, he requests
this Court to set aside the rejection order and condone the delay subject to any
terms.

5. On the other hand, the learned counsel appearing for the respondents
would submit that though all the notices and orders were duly uploaded by the
respondents, the petitioner had failed to file the appeal in time. Hence, he would
contend that the said delay has occurred only due to the fault on the part of the
petitioner and requests this Court to pass appropriate orders.
6. Heard the learned counsel for the petitioner and the respondents and
also perused the materials available on record.
7. In the case on hand, initially, the assessment orders dated 24.12.2025

came to be passed by the 1 respondent. Aggrieved over the said assessment
orders, the petitioner filed the appeals on 30.04.2026 & 06.05.2026 with a delay
of 6 days and 12 days, respectively. Since the said delay is beyond the

consultant, they were unable to file the appeals within time.
8. The above reasons assigned by the petitioner, for the delay in filing the
appeal against the assessment order, appears to be genuine. In such view of the
