NEW INDIA CHURCH OF GOD BETHESDA ASHRAM 1018 BHATI
VILLAGE CHATTARPUR ROAD NEW DELHI
Versus
STATE OF MADHYA PRADESH AND OTHERS
Appearance:

ORDER
This petition under Article 226 of the Constitution of India has been
filed by the petitioner seeking following reliefs:-
"(i) That, the impugned order dated 02.11.2026 contained in
Annexure-P/1 may kindly be quashed and the respondents
No.2,4&5 may kindly be directed to grant permission in favour of
the petitioner to organize peaceful leader training camp at their
own responsibility forthwith in the interest of justice.
(ii) That, cost of the petition be awarded or any other order
deemed fit in the circumstances of the case be issued in favour of
the petitioner."
Learned counsel for the petitioner submits that the petitioner is a
registered society engaged in various social activities and has been
organizing similar leadership training camps for more than ten years with the
permission of the local administration. It is contended that the present camp

is proposed to be organized peacefully at the petitioner’s own premises, with
approximately 1000–1500 participants expected to attend. The application
seeking permission was submitted on 07.10.2026; however, permission has
been declined primarily on account of the apprehension of law and order
problems and the inability of the police authorities to provide police force
during the Diwali festival.
Learned counsel for the petitioner further submits that the petitioner
has neither sought deployment of police personnel nor intends to depend
upon the State machinery for security arrangements and is willing to make
its own arrangements to ensure the peaceful conduct of the camp. It is
submitted that the petitioner is also ready to furnish an undertaking by way
of affidavit through its responsible office-bearer, assuring compliance with
all lawful conditions imposed by the competent authority. It is, therefore,
prayed that the respondents be directed to permit the petitioner to organize
the proposed camp, subject to such reasonable conditions as may be
necessary.
Per contra, learned counsel for the State submits that the authorities
are required to ensure maintenance of public order and prevent any untoward
incident, particularly in view of the prevailing circumstances and the
anticipated gathering of a large number of participants. It is submitted that
the competent authority shall impose appropriate conditions and seek
necessary undertakings from the petitioner to ensure that the proposed
programme is conducted peacefully and without disturbance to public order.
Heard learned counsel for the parties and perused the material

available on record.
Having regard to the nature of the proposed programme, the
submissions advanced by learned counsel for the parties and the willingness
expressed by the petitioner to abide by reasonable conditions, this Court is of
the considered view that the apprehension relating to law and order can
appropriately be addressed by imposing suitable conditions and obtaining an
undertaking from the petitioner, rather than declining permission outright.
It is well settled that the competent authority is entitled to impose
reasonable and lawful conditions to ensure maintenance of public order,
safety and security. At the same time, such conditions ought to be
proportionate to the nature of the proposed activity and should not operate as
an unnecessary impediment to the peaceful conduct of the programme.
Accordingly, without expressing any opinion on the merits of the
challenge to the impugned order dated 02.11.2026, the present petition is
disposed of with a direction to the respondent/State authorities, particularly
the competent authority, to consider the petitioner’s request for permission to
organize the aforesaid Leadership Training Camp and to impose such
reasonable and lawful conditions as may be considered necessary for
maintenance of law and order, public safety and peaceful conduct of the
programme.
In the event the competent authority considers it necessary to obtain an
undertaking or affidavit from the petitioner in respect of any such conditions,
the petitioner shall, immediately upon being called upon to do so, furnish an
affidavit sworn by its responsible office-bearer, undertaking to comply with

all the conditions so imposed and to ensure that the programme is conducted
peacefully, without causing any disturbance to public order or inconvenience
to the general public.
The competent authority shall take an appropriate decision forthwith,
keeping in view the scheduled dates of the programme, and communicate the
same to the petitioner without delay.
It is made clear that the petitioner shall strictly comply with all the
conditions imposed by the competent authority, and any violation thereof
shall entail consequences in accordance with law.
With the aforesaid directions, the petition stands disposed of.
