Writ petition filed under Article 226 of the Constitution of India praying
for issuance of a writ of mandamus directing the 5th respondent to approve the
appointment of the petitioner as a secondary grade teacher in the 7th respondent
school from the date of appointment i.e., from 13.06.2022 along with attendant
ad monetary benefits and to pass

ORDER

(1) The present writ petition is filed for a mandamus, to direct the 5
respondent to approve the appointment of the petitioner as Secondary
th
Grade Teacher in the 7 respondent School, i.e., from 13.06.2022 along
with attendant and monetary benefits.
(2) Such prayer was stoutly objected by the learned Additional Government
Pleader on the ground that the petitioner was appointed in contravention
to the communal roster, as the post is reserved for SC and ST candidates.
Even in the absence of candidates under the above communal category
under Rule 15[a][a][ii] of the Tamil Nadu Private Schools Regulation
Rules, 1974, it would carry forward to the next recruitment and even in
the next recruitment, if there are no suitable candidates, it would lapse
and the candidate from the other category would be filled in.

(3) The learned counsel for the petitioner submitted that in the case on hand,
without adopting such procedure, the petitioner was appointed and in this
regard, they have returned a proposal seeking for clarification.

(4) At this juncture, the learned counsel for the 7 respondent would submit
that they would submit a fresh proposal after complying with the returns
within a reasonable time.
(5) In such view of the above submission and considering the limited relief of

considering the fresh proposal to be submitted by the 7 respondent, this
Court is inclined to dispose of the writ petition with the following
direction:-

(a)The 7 respondent School is directed to re-submit the proposal after
complying with the clarification sought for, within a period of two
weeks from the date of receipt of a copy of this order.

(b)On receipt of such proposal from the 7 respondent, the 4 respondent
is directed to consider such proposal, according to its own merits and
in accordance with law and pass appropriate orders within a further
period of eight weeks from the date of receipt of such proposal.
(6) With the above direction, the writ petition is disposed of accordingly. No
costs.
