Prayer: Writ Petition under Article 226 of the Constitution of India praying for a
Writ of Mandamus directing respondents 1-11 to remove the encroachment
made by the 12th respondent in the lake bund of Puthuthangal Lake,
comprised in Old Survey No.256, New T.S.No.2, Ward D, Block 10 Tambaram
West, Tambaram Taluk, Chengalpet District by constructing Gengai Amman
Temple and erecting a gate by demolishing the security wall and constructed
steps and consequently direct the respondents 1-11 to restore the original
security wall of the lake bund of Puthuthangal Lake by considering the Notice
dated 28.06.2023 in Form III under Rule 6 of the Tamil Nadu protection of
Tank and Eviction of Encroachment Rule 2007.

ORDER
(Order of the Court was made by S.M.Subramaniam J.)
The present writ petition has been instituted seeking removal of
encroachment from the water body, namely, Puthuthangal Lake.
2.The learned Government Advocate would submit that Form 3 notice
has been issued to the encroachers. Therefore, the enforcement action will
be continued with the aid of the police.
3.In view of the said submission and considering the fact that
encroachments are identified in the water body, the official respondents are
directed to continue the enforcement actions by following procedures as
contemplated under the relevant Statute and Rules in force and remove the
encroachments from the water body and resume the water body and protect
the same to subserve public goods within a period of twelve weeks from the
date of receipt of a copy of this order.
4.With the above directions, this writ petition stands disposed of. No
costs.
