The Original Applications having been heard on 25.03.2026, the Tribunal
on 12.10.2026 delivered the following:
COMMON ORDER
Justice K.Haripal, Judicial Member
As common questions are raised, these Original Applications have been
clubbed, heard together and are being disposed of by this common order.
2. All the applicants are Railway employees working in Palakkad
Division in different categories like Pointsman, Track Maintainer, Commercial
Clerk and Shunting Master. They hail from other States of the country -
Rajasthan, Uttar Pradesh, Bihar, Delhi and Jharkhand. All of them were
employed in Southern Railway as recommended by the Railway Recruitment
Cell or Railway Recruitment Board, Chennai. Thereafter, they were promoted
to higher grades. On completion of the residency period, they sought inter-
Railway transfer to their native places and made appropriate representations
through the HRMS portal. All of them obtained 'No Objection Certificates',
NOC for short, from the respective receiving divisions of the transferee Railway.
Deepa S 2026.10.16 16:12:20+05'30'
16
3. The grievance of the applicants is that on the strength of NOCs
when they made representations for relieving from the present posts, they are
not being relieved. Thus they have moved these applications for directing the
respondents 1 to 3 to relieve them to carry out the inter-Railway transfer to the
respective receiving divisions.
4. It is the common case of the applicants that the Railway has taken
liberal policy in granting such inter-Railway transfers. Thus their requests were
entertained and forwarded for one way, on request transfers to different
Divisions/Railways, wherever they required transfer. Then the receiving
divisions gave their consent and issued NOCs. Still, there is no justification in
not relieving them, which is against the principle laid by this Tribunal in
O.A.Nos.444/2014, 321/2014, 264/2014 and other connected cases. This
Tribunal had held that shortage of staff is not a ground for refusal to relieve. In
O.A.576/2017 and O.A.277/2017 also this view was reiterated, which has been
confirmed by the Hon'ble High Court.
5. According to the applicants, in the light of the standing
instructions and circulars of the Railways, the respondents are not justified in
keeping their requests for relieving, citing adverse vacancy position. The
Railway Board has taken a policy decision to take expeditious action on inter-
Deepa S 2026.10.16 16:12:20+05'30'
17
Railway transfer requests.
6. Delay in relieving them from the present stations would have far
reaching effects in their future career prospects. They will have to join at
bottom seniority in the new stations. All of them had made requests for inter-
Railway transfer forgoing the promotion obtained in Southern Railway.
Therefore, any further delay would cause them substantial prejudice.
7. Respondents have opposed the Original Applications almost on
identical lines. According to them, transfer module of HRMS was
operationalised with effect from 15.08.2022. Representations submitted by
the applicants were forwarded to different Divisions/Railways through HRMS
portal with the approval of the DRM, who had approved the same on condition
that the transfer orders of the employees will be 'issued by the Southern
Railway only after a reliever from RRC/RRB joins in his place'.
8. As per the Railway Board circular, RBE No.73/2024 dated
02.08.2024, the validity of NOC is for one year. In case transfer is not effected
within one year, such NOC is required to be re-validated. Moreover, employee
shall be relieved only after confirming the validity of the NOC.
9. Further, it is submitted that, in the matter of transfers,
Government is the best judge to decide as to how services of employees
Deepa S 2026.10.16 16:12:20+05'30'
18
should be distributed and utilized. It is to be left to the discretion of the
employer and their honest decision should be accepted as a part of service
discipline. Transfer is effected based on several factors including suitability of
the person for a particular post and exigencies of administration. At times,
several imponderables, requiring formation of a subjective opinion may be
involved. As such, the realistic approach is to leave it to the wisdom of
hierarchical superiors. They have also quoted the decisions of the Apex Court
in SK Nausad Rahaman and others v. Union of India and others [(2022) 12 SCC
1], Union of India and others v. S.L.Abbas [(1993) 4 SCC 357] and also Namrata
Verma v. State of Uttar Pradesh and others [SLP No.36717/2017].
10. Further, it is submitted that the limited purpose of the NOC is to
ascertain/confirm, availability of vacancies in the accepting Railway, it is not a
guarantee that the employee will be definitely transferred on receipt thereof
on the face of acute shortage of staff. The applicants were never assured that,
before the expiry of the period of NOC they would be relieved. Administrative
transfers are covered by vacancy position, service exigencies and approval of
the competent authority.
11. All the applicants were recruited through Railway Recruitment
Cell/RRB, Chennai. At the time of applying for the post in Railway, they knew
Deepa S 2026.10.16 16:12:20+05'30'
19
that on being selected, they would be appointed somewhere in Kerala or Tamil
Nadu. The primary responsibility of the Railway is to ensure safer services for
the travelling public. So, the interest of the organisation is supreme. The
request for relief have not been rejected, but only withheld pending receipt of
replacement of candidates from RRB/RRC.
12. According to the respondents, transfer cannot be claimed as a
matter of right. In many categories recruitment process is under way.
Moreover, several new projects and works like doubling works, installation of
thick web switches to enhance the sectional speed of trains, are presently in
progress. In many cadres like Track Maintainer, acute shortage of staff is
experienced. Even after completion of the ongoing recruitment the vacancy
position may remain around 10%. This situation is aggravated due to the
creation of newly added Railway assets as well as for manning of level crossings
during the last 10 years. At present, a significant number of Track Maintainers
are being utilized for Gate Man duties due to large-scale manning of level
crossings. Most of the applicants are working in safety category and therefore,
they can be relieved only after getting clearance from the higher-ups.
13. In all the reply statements, the respondents have highlighted
shortage of staff. Statistics have been given showing the sanctioned strength,
Deepa S 2026.10.16 16:12:20+05'30'
20
actually available working strength of staff and the vacancy position.
Therefore, the applicants can be relieved depending upon the threshold
vacancy position. In the case of Track Maintainer cadre, the vacancy position is
18.28% and if only it is brought down to below 10%, on the basis of the RBE
Circular, such category of employees can be relieved. Thus, the respondents
have prayed for dismissing the OAs.
14. We heard the learned counsel for the applicants as well as the
learned Standing Counsel for the respondents.
15. Applicants are natives of either Rajasthan, Delhi, Bihar, Jharkhand
or Uttar Pradesh. They were recruited by the Railway Recruitment Cell/RRB,
Chennai; naturally they are eager to get transfer to or near to their native
place. On completion of the respective residency period, they made
representations through HRMS portal seeking inter-Railway transfer. All of
them have received NOCs also from the respective Railways. Now they are
aggrieved by the stand of the authorities in Palakkad Division in not relieving
them.
16. The following table will give a general idea about the name, cadre,
work place, nativity, details of Division/Railway to which transfer is sought,
details of NOCs etc.:

17. In all the cases, interim orders have been granted to the effect that
the respective NOCs will remain valid till the next date of posting.
18. Initially, period of validity of the NOC was six months. Later,
Deepa S 2026.10.16 16:12:20+05'30'
23
finding that an aspirant may not be able to move to the new station within the
said period, the Railways have fixed the period of validity as one year. All these
applicants have moved the Tribunal before the expiry the said one year from
the respective dates of issue of the NOC. The validity of the NOCs is kept alive
on the strength of the interim orders.
19. The common grievance is that despite the issue of NOCs the
applicants are not being relieved, their requests have been put on hold on the
ground of shortage of staff. In some cases, it is submitted that the officers in
Palakkad Division are keeping priority list in each cadre and the applicants will
be relieved only when their turn comes. They have also given the statistics
showing the sanctioned strength of employees, current working strength and
vacancy position. According to them, cadres like Pointsman, Track Maintainer
and Shunting Master are safety categories. Since the vacancy position remains
high, they cannot be relieved for the present. If such unilateral relief is done
en masse, that would affect the operation of trains and public interest, it is
submitted.
20. As stated earlier, except the applicant in O.A.96/2026, who is a
Chief Commercial Clerk, who started as a Commercial Clerk, all other applicants
are either Pointsman, Track Maintainer or Shunting Master, who started as low
Deepa S 2026.10.16 16:12:20+05'30'
24
paid employees in the Southern Railway, recruited through the RRC, Chennai.
All of them are working away from their home land and were very much eager
to go back to their native place, which made them to submit applications for
inter-Railway transfer by registering their requests in the HRMS portal. An
employee can seek such a transfer only after completing the minimum
residency period. All of them have satisfied the required conditions. Even
after making such applications they had to wait for long for getting the NOCs.
In this connection, it is important to say that the policy of the Railways is to
promote such transfers and dispose of the requests as expeditiously as
possible.
21. In the RBE Circular No.153/2019 dated 20.09.2019 it is stated thus:
“It has come to the notice of Board that a large number of
inter-Railway/inter-Division one-way transfer requests are being
forwarded by some of the Zonal Railways for NOCs without
assessing the feasibility of relieving such staff on receipt of NOC.
This causes unnecessary building up of expectations regarding their
imminent sparing among such employees and puts avoidable
pressure on the Railway administration.
2. Considering the above, Railways may ensure that
henceforth only such Inter-Railway transfers requests be forwarded
where there is reasonable possibility of relief in case of acceptance
by the railway to which transfer is sought. While doing so, various
Deepa S 2026.10.16 16:12:20+05'30'
25
factors like number of staff likely to be inducted in the cadre by way
of departmental promotions/Inter-Divisional/Inter-Railway Transfer
from other Railways/Divisions and through RRB indents should be
kept in view so that once NOC is received, the concerned employee
can be relieved early.”
22. That means, it is obvious that while forwarding the request itself,
the division concerned makes an assessment of the implications of relieving
such an employee on accepting the request by the transferee division. Of
course, when delay occurs in getting the NOC situations may change and at
that point of time vacancy position also is likely to change and the parent
organisation may not be in a position to relieve the employee. All the same,
when such a request is forwarded after making an assessment of the vacancy
position in the division, they are estopped from saying that the applicants
cannot be relieved on producing the NOC.
23. In all the replies, the respondents have stated that the applicants
cannot be relieved due to shortage of staff, by giving the statistics. These
statistics was prepared basing on the position on a particular date. Such
figures are not static. That is likely to change by the change of circumstances.
It was consistently held by this Tribunal as well as by the Hon'ble High Court
that shortage of staff is not a justification for not relieving a candidate on
Deepa S 2026.10.16 16:12:20+05'30'
26
producing the NOC from the transferee division.
24. Once an application for transfer is forwarded, it is for the parent
division to foresee such a transfer and take appropriate steps, well in advance.
They are also in receipt of similar requests from other zones or divisions, for
appointment by transfer. As stated earlier, applications for inter-divisional
transfer were forwarded means the parent division has made atleast a rough
assessment of the implications of such transfers. Once the employee produces
the NOC it is improper to keep it under the carpet for long.
25. Basing on S.L.Abbas etc., quoted supra, the respondents wanted to
say that it is for the employer to decide where the employee should work etc.
Such principles are applicable only in the case of a routine transfer; here it is
not. Here, the applicants, who are low paid employees of the Railways seek
inter-Railway transfer to their home State, which is permissible under the
circulars and standing instructions issued by the Railways. The Railway has
adopted a policy, encouraging and promoting such transfers. Instructions are
also in place to expedite the processing of such transfer requests. Here, the
applicants have not sought for transfer as an absolute incidents of service, but
seek effective implementation of the NOCs received by them from the
transferee division, which were issued on the basis of the endorsement of the
Deepa S 2026.10.16 16:12:20+05'30'
27
transfer requests made by the parent division. Railway is a large establishment.
They have their own system of recruitment, training etc. They are able to
foresee such contingencies in advance. It is not difficult for them to relieve
such low paid employees, which is in effect a welfare act which enable them to
work from their home station or native place.
26. Human resource is the biggest resource available in our country.
Unemployment/under employment is a never ending menace in our society.
Large number of unemployed youths are available in open market, waiting for
opportunities. In cases like Track Maintainer or Pointsman, much technical
knowledge is not necessary. Only thing is that they should be subjected to the
process of recruitment and impart basic training, which is not a big task for the
Railways. They have at their disposal the paraphernalia for the same. Only
thing is that Railway should be able to make long term and short term plans for
meeting the contingencies.
27. We are not averse to the practical difficulties narrated by the
respondents in relieving the employees working in safety categories. If large
number of such employees are relieved in one go, that will adversely affect the
operation of trains and will prejudice public interest. At the same time, the
interests of the employees have to be protected. The respondents can chalk
Deepa S 2026.10.16 16:12:20+05'30'
28
out long term plans for keeping the threshold vacancy level always to the
minimum.
28. After considering the rival contentions, we are of the view that the
requests for relief made by the applicants cannot be rejected or put on hold
indefinitely. Therefore, the respondents are directed to relieve the applicants
within a maximum period of six months from the date of receipt of a copy of
this order.
29. It goes without saying that, since the NOCs were issued years
before, prior to issuing individual orders, existence of vacancy in the division
where transfer is sought shall be re-confirmed.
The Original Applications are allowed as above. Interim orders are made
absolute. No costs.
