Prayer : Writ Petition filed under Article 226 of the Constitution of
India, to issue a Writ of Certiorarified Mandamus, calling for the records
related to the impugned proceedings of the Commissioner of Sivakasi
Municipal Corporation dated 25.01.2023 in Na.Ka.No.6921/2017/F1 and
earlier proceedings of the Commissioner of Sivakasi Municipality (as it then
was) dated 03.08.1995 in Mu.Mu.F1/8887/94 and also the proceedings of
the Secretary to the Government of Tamil Nadu, Municipal Administration
and Water Supply department dated 27.06.1997 in G.O.(10 years) No.298
and quash them and consequently issue a direction to the respondents
forbearing them from interfering with the right, title, possession and
enjoyment of all the petitioners over the schedule mentioned property and
its usage as a Community Hall for the common benefits.

Heard both sides.
2. The petitioners challenge the impugned lock and seal order passed
by the Commissioner, Sivakasi Municipality. The petitioner which is a
community organization has put up a hall in a OSR land. The petitioners’

counsel states that the description of OSR may not be correct. According to
him, it was a land earmarked as “well and garden”. Admittedly, no approval
was obtained for putting up the construction. This happened way back in
the year 1996. Since a disgruntled member of the Uravinmurai raised the
issue, all these adverse developments happened to take place. The
petitioners’ counsel states that he may be permitted to approach the
Government and seek relaxation and regularization.
3. We grant such liberty. It is for the petitioners to move the
Government and obtain an appropriate order in their favour subject to
terms and conditions. As and when such an order is passed, it would be
open to the private respondents herein to challenge the same also.
4. Ms.Shri Arthi, Assistant Engineer(Planning) is present in person.
We direct the Commissioner, Sivakasi Municipality in her presence to
enforce the order impugned in the writ petition on 27.10.2026. The rights
of the petitioners will abide by the order to be passed by the Government.
This writ petition stands disposed of, accordingly. No costs. Consequently,
connected miscellaneous petition is closed.
