6. Per contra, learned counsel for the respondent - State opposes the

application on the ground of gravity of alleged offence.
7. According to the material available on case diary, Shivkumar Jaiswal
submitted a written complaint to the S.H.O, of Police Station - Raingnod, District -
Ratlam inter alia alleging that Munnalal Jaiwal had expired on 20/08/1996 at
Raltam. He is survived by his wife Kamlesh Kumari and sons Sanjay and Satish.
Junaid, Nadir Kha and Munnalal Chouhan came to their agricultural on
02/10/2022 and informed that they had purchased the land from Munnalal Jaiswal.
Some imposters have executed the sale deed dated 15/09/2023 in favour of Junaid
and Nadir and another sale deed dated 20/09/2023 in favour of Munnalal
Chouhan. The complaint was inquired into. It was revealed that Rajesh in
association with other accused impersonated Munnalal Jaiswal and executed false
sale deeds in favour of Junaid, Nadir and Munnalal Chouhan. The applicant was a
witness to the sale deed dated 15/09/2023. The applicant was arrested on
02/11/2025. He is in custody ever since. The trial would take time to conclude.
The veracity of prosecution and complicity of the applicant in the alleged offence
will be determined after evidence in the trial. Prashant Yogi has also been
extended benefit of bail by the Supreme Court considering the submission that he
is only a witness to the sale deed. He has not identified the person executing sale
deed. The prosecution against applicant is similar in nature.
8. As informed, the applicant is aged around 27 years and is labourer by
profession. He has the family responsibilities. Considering these aspects, there
appears to be no possibility of fleeing from justice. In absence of substantial
criminal past and previous conviction for any major offence, considering the
socio-economic status of the applicant, there appears to be no likelihood of

tampering with evidence or influencing the witnesses by the applicant. There

appears to be no compelling reason to continue incarceration of the applicant.
However, the observations, herein-above, are recorded for present application
only.
9. Considering the rival contentions and overall circumstances of the case,
in the light of aforestated facts, but without commenting on the merits, this Court
