investigation is over, therefore, there is no requirement of further custodial

interrogation of the applicant. Trial is likely to take long time to conclude.
Applicant is the permanent resident of District - Ashoknagar (M.P.).
Therefore, counsel for the applicant prayed for bail to the applicant.
4. Learned Public Prosecutor for the State has vehemently opposed the
prayer on the ground of long criminal record and submitted that applicant is a
prime accused in the present case and he is a habitual offender and all the
facts have been decided while dismissing the second bail application of the
applicant, therefore, he prayed for dismissal of this case.
5. Heard the learned counsel for the parties and perused the case diary
as well as documents appended thereto.
6. Allegation against the present applicant pertains to an offence of a
grave and serious nature, involving a deliberate and premeditated assault
with a lethal weapon. The victim survived due to timely medical intervention
and the applicant’s act shows clear intention to cause death or grievous harm.
The material collected during investigation prima facie establishes the
involvement of the applicant in commission of the alleged offence. The
nature of the injuries inflicted, the weapon used and the circumstances of
assault reveal a serious and heinous offence, carrying severe punishment
upon conviction.
7. At the stage of consideration of bail under Section 483 of BNS, the
Court is required to assess the gravity of the offence, the nature of the
accusations, the possibility of tampering with evidence, and the likelihood of
the accused fleeing from justice. In the present case, considering the brutality

of the attack and the fact that the victim suffered a life-threatening stab

wound, this Court is of the view that the applicant does not deserve the
discretionary relief of bail at this stage. This Court also finds substance in the
apprehension of the prosecution that release of applicant may lead to threats,
coercion or undue influence upon material witnesses, who are residents of
the same locality.
8. It is also pertinent to note that out of the three additional witnesses
examined, only one injured has not supported the allegations, but two of
them have categorically levelled allegations against the present applicant
clearly implicating him.
9 . In view of the aforesaid facts and circumstances, the gravity of
offence and the prima facie evidence available on record and also the fact
that no new change in the circumstances of the case, this Court does not find
any justifiable ground to enlarge the applicant on bail.
10. Accordingly, the present bail application stands rejected.
11. However, trial court is directed to expedite the trial of the case and
conclude the same within a period of three months.
12. Office is directed to send a copy of this order to the concerned trial
court and list this case after three months under the head of "Direction
Matters"
