applied under the SC category and appeared in the
written examination conducted on 05.03.2017. Having
qualified the written examination, they were
shortlisted and submitted their e-dossiers. However,
their candidature was subsequently rejected vide
Rejection Notice No. 260 on the ground of having less
than 10 years’ experience as Anganwadi Workers.
Aggrieved by the rejection, the applicants submitted a
representation/legal notice to the respondents, but
having received no favourable response, they have
approached this Tribunal.

relies upon the averments made in the counter
affidavit. He draws our attention to the essential and
desirable qualifications prescribed for the post, as
advertised, which reads as under:
Essential Qualification: Graduation, preferably in

Item No.129/ C-IV O.A. No.1427/2019
4. Learned counsel for the respondents submits
that the applicants had applied under the sub-
category of Anganwadi Workers and, therefore, were
required to possess Matriculation with 10 years’
experience as Anganwadi Workers. Learned counsel
submits that, as per their experience certificates, the
applicants had joined the Department of Women &
Child Development as Anganwadi Workers only on
13.05.2011 and 02.07.2011 respectively and, thus,
had only about three years’ experience when they
applied pursuant to Advertisement No. 02/2014.
They, therefore, did not fulfil the essential eligibility
condition prescribed for candidates applying under
the Anganwadi Worker sub-category. It is further
submitted that their candidature was accordingly
rejected by DSSSB vide Rejection Notice No. 260.
5. Learned counsel for the applicant submits that
the case of the applicant falls within the parameters of
the essential qualification prescribed under the
Recruitment Rules, particularly with reference to the
qualification reflected at pages 40-41 of the record.
6. We have considered the submissions made
by learned counsel for the parties and perused the

Item No.129/ C-IV O.A. No.1427/2019
material available on record. It is not in dispute that
the applicants had applied under the sub-category of
Anganwadi Workers. The Recruitment
Rules/advertisement specifically prescribe 10 years’
experience as Anganwadi Worker as an essential
requirement for candidates applying under the said
sub-category.
7. It is also an admitted position that the
applicants had joined as Anganwadi Workers only on
13.05.2011 and 02.07.2011 respectively and,
therefore, did not possess the requisite 10 years’
experience as on the relevant date. Merely possessing
a degree of Bachelor of Arts (B.A.) would not dispense
with the specific experience requirement applicable to
candidates who seek consideration under the
Anganwadi Worker sub-category.
8. Learned counsel for the respondents, per contra ,
also relies upon the judgment dated 15.07.2026
passed by the Hon’ble High Court of Delhi in W.P.(C)
No. 2818/2024, Govt. of NCT of Delhi & Anr. v.
Manu & Ors. , and submits that the issue raised in
the present O.A. already stands settled against the
applicants.

Item No.129/ C-IV O.A. No.1427/2019
9. In view of the aforesaid position and having
regard to the specific eligibility conditions prescribed
for candidates applying under the Anganwadi Worker
sub-category, we find no infirmity in the rejection of
the candidature of the applicants for want of the
requisite 10 years’ experience.
10. Accordingly, the present O.A. is devoid of merit
and is dismissed. Pending M.A.s, if any, also stand
disposed of accordingly. There shall be no order as to
costs.
