ANOTHER has held that even in a case where the offence
committed is under Section 307 of IPC, the Court can
quash the proceedings based on the settlement in certain
circumstances.
9. Learned counsel also referred to the judgment
of the Co-ordinate Bench of this Court in Criminal Petitions
No.6509/2026 and 15126/2025 to urge the contention
that the Co-ordinate Bench of this Court has followed the
judgment of the Apex Court in Narinder Singh supra to
quash the proceedings where the offence alleged is under
Section 307.
10. The Court has made inquiry with he victim who
is present before the Court.
11. The victim who is present before the Court
would submit that he had sustained minor injuries and he

12. It is further submitted that the incident took
place in the background of a claim for compensation where
the vehicle belonging to accused No.1 had met with an
accident injuring the victim. That the vehicle met with an
accident was not reported to accused No.1 and when the
notice was issued by the victim to the owner of the vehicle
demanding compensation, the meeting was held to settle
the issue. In that meeting, the alleged scuffle took place
all of a sudden. Thus, it is the contention that there was
no criminal intent and this kind of offence cannot be
treated as an offence against the society.
13. The learned HCGP would submit that two of the
accused are rowdy-sheeters.
14. The Court has considered the contentions
raised in the aforementioned judgments.
15. The Apex Court in the case of Narinder Singh
supra has held that in certain cases, notwithstanding the
fact that the offence invoked is Section 307 of IPC, the

Court can accept the settlement entered into between the
parties, especially in a situation where the settlement is
arrived at before the evidence has commenced.
16. It is also noticed that there is a background to
the case in the sense that a claim for compensation was
being negotiated between the parties and that being the
position, it appears that all of a sudden the scuffle has
taken place between the parties.
17. Since, the victim who is present before the
Court has submitted that he has suffered only minor
injuries and he has completely recovered and he is not
suffering from any disability, the Court is of the view that
the prosecution may not serve any purpose as he may not
support the case of the prosecution.
18. The wound certificate produced along with the
charge sheet indicates simple injuries. Thus, charge under
Section 307 of IPC may not sustain.
