residence in Bren woods (Flat No. C 401). Background
for this altercation is dispute on garbage. The owner of
C-402 (Mr. Chandrashekhar and Neha Gupta) throw
garbage in common area of flat corridor. After observing
same for many months, we raised a complaint in our
society complaint register with Mygate App. After that
they started abusing us as why we have raised such
complaint. Same is recorded in our vigilance camera. To
make sure that they are abusing us, I had recorded their
abuse to raise this issue in annual general meeting about
their behaviour. This time Mr. Neha Gupta smashed my
phone and got aggressive, in my defence when I pushed
her away, her husband Mr. Chandrashekhar Gupta came
upon me with an intention to harm me. I was in
immediate danger in my vicinity from his attack, then
my husband intervened to stop Mr. Chandrashekhar
Gupta and to save me from his attack. This incidence is
also recorded. Currently I am undergoing my IVF
treatment and this is causing me distress and risk to my
personal well-being and life.

My neighbor Anant Gopal & Swathi Sharma have been

Anant Gopal started insulting him and called him beggar
and unable to afford garbage bags infront of current FM

When my husband talk back to Ravi on this behavior,
Anant Goipal again intervened and called my husband

respondent no.2 had intervened and abused the
petitioners. Upon objecting to their behavior, there
were heated arguments after which petitioner no.2 is

said to be recorded on the mobile phone. It is alleged
that petitioner no.2 had smashed the mobile phone
of the complainant, got aggressive with her, and
when her husband came to protect her, he was also
attacked.
9. It is rather unfortunate that two neighbours have
engaged in a dispute which has escalated beyond
verbal altercation into physical violence.
10. The parties to the two petitions are neighbours
residing in the same apartment complex, and the
rival complaints arise out of the same incident. The
complainant in Crl.P. No. 1498/2025 alleges that,
while her husband was leaving for work, he was
insulted by Anant Gopal over the issue of garbage
and that the ensuing verbal altercation escalated into
physical violence. It is alleged that Swathi Sharma
engaged in a physical altercation with the
complainant and that Anant Gopal assaulted the
complainant's husband, causing injuries to his left
eye and fractures of the nasal bones.

11. The complaint forming the basis of Crl.P. No.
4984/2024 presents the other side of the incident. It
alleges that garbage was being dumped in the
common corridor and that, after a complaint was
raised through the residents' association's channels,
the complainant was abused. It is further alleged
that her mobile phone was smashed and that, when
her husband intervened to protect her, he too was
assaulted. The complaint refers to the alleged
availability of CCTV or vigilance-camera footage and
mobile-phone recordings.
12. The medical records relating to the complainant's
husband in Crl.P. No. 4984/2024 disclose an injury to
the left eye, accompanied by pain and swelling
around the left eye and nose. The CT scan of the
brain and paranasal sinuses reportedly revealed
fractures of both nasal bones and a small defect in
the floor of the anterior cranial fossa. The records
further indicate that, on 16.02.2024, he underwent
reduction and splinting of the nasal bone fractures
and repair of the left lower eyelid, involving the
muscle and skin, under general anaesthesia,
following which he was discharged.

13. The medical records referred to in Crl.P. No.
1498/2025 similarly disclose swelling of the upper
and lower eyelids on the left side, with periorbital
bruising. A laceration measuring 3 cm × 0.2 cm ×
0.2 cm was noted over the left lower eyelid, with a
tear of the orbicularis muscle. The CT scan revealed
fractures of both nasal bones with minimal
displacement and a small defect, measuring
approximately 1.1 mm, in the floor of the anterior
cranial fossa, to the right and anterior to the crista
galli. The medical opinion records the third injury as
grievous.
14. The rival complaints and the medical records prima
facie indicate that a physical altercation occurred and
that injuries were sustained. Both sides attribute the
initiation and escalation of the incident to the other.
Learned counsel appearing for the respective parties
seek to rely upon their clients' versions and contend
that the other side was responsible for the
occurrence. However, the question as to who
initiated the altercation, the precise role played by
each individual, the circumstances in which the
injuries were sustained and the culpability, if any, of

determined on the basis of the evidence in the
criminal proceedings.
15. At this stage, the Court is not required to determine
the truth of the rival allegations or to conduct a
detailed assessment of the evidence as though it
were deciding the matter after trial. The medical
records lend prima facie support to the allegations
concerning the injuries, while the rival complaints
disclose materially contested accounts of the
incident. In these circumstances, the Court finds no
sufficient ground to quash the proceedings. The
allegations and the evidence relied upon by the
parties must be considered by the competent court in
accordance with law. No opinion is expressed on the
guilt or innocence of any of the parties.
16. Before parting with the matter, this Court considers
it appropriate to make a few observations concerning
the unfortunate escalation of disputes between
neighbours. The present cases arise from a
disagreement over the disposal of garbage in the
common area of an apartment complex. An issue
that could ordinarily have been addressed through a
discussion, a complaint to the residents' association

or recourse to an appropriate grievance-redressal
mechanism has allegedly escalated into physical
violence, serious injuries and criminal proceedings. It
is unfortunate that a dispute concerning such an
everyday aspect of residential life has brought the
parties before a criminal court.
17. Neighbours occupy a distinctive place in the daily
lives of individuals and families. Unlike many other
relationships, a neighbour is not ordinarily someone
whom one can simply choose to replace. The houses
and flats remain in their respective locations, and,
unless one of the households moves elsewhere, the
same neighbours are likely to encounter one another
day after day. They share common spaces and
facilities and participate in the affairs of the same
residential community. A disagreement lasting only a
few minutes can, if allowed to escalate, create
hostility that persists for years. The parties may then
find themselves living in an atmosphere of suspicion
and resentment, even in the very place where they
ought to feel safe and at peace.
18. The familiar exhortation, “Love thy neighbour”,
embodies a principle of practical importance for

peaceful coexistence. It does not demand that
neighbours agree on every matter or surrender their
legitimate rights. It calls for civility, tolerance,
mutual consideration and a willingness to resolve
differences without unnecessary confrontation.
Disputes concerning garbage, parking, noise or the
use of common areas may understandably cause
inconvenience and frustration. Such grievances,
however, ought not to become contests of ego in
which neither side is willing to exercise restraint. A
calm conversation or the intervention of the
residents' association may often resolve the issue
without allowing it to assume consequences wholly
disproportionate to the original disagreement.
19. The resort to physical violence is never an acceptable
means of resolving a neighbourhood dispute. A
person who believes that a neighbour has acted
improperly must pursue lawful remedies rather than
take the law into his or her own hands. Equally, a
genuine grievance should not be allowed to justify
intimidation, abuse or retaliation. The ability to
exercise restraint in the face of provocation is not a
sign of weakness; it is an essential safeguard against

the escalation of an ordinary disagreement into a
serious incident.
20. Once allegations of criminal conduct are made and
the criminal law is set in motion, the dispute no
longer remains merely a private disagreement
between neighbours. The parties may be required to
participate in the investigation, attend court
proceedings, engage legal counsel and undergo the
demands of a criminal trial. Depending upon the
offences alleged and the evidence ultimately
established, the proceedings may result in conviction
and the imposition of a sentence, including
imprisonment where the law so provides. Such
consequences can extend well beyond the moment of
anger in which the alleged conduct occurred,
affecting the individuals concerned and their families
through legal expense, uncertainty and prolonged
conflict.
21. The present cases illustrate the seriousness with
which an everyday dispute can escalate. The medical
records refer to injuries, including fractures, allegedly
sustained during the altercation. The parties would
do well to reflect upon how a disagreement

concerning garbage has resulted in two sets of
criminal proceedings and brought them before this
Court. Continued hostility is unlikely to serve any
constructive purpose. It may instead deepen the
bitterness between households that are likely to
remain neighbours for the foreseeable future.
22. The parties are, therefore, advised to exercise
restraint and conduct themselves with civility and
mutual respect. Any genuine grievance concerning
the use of common areas or other residential matters
should be addressed through dialogue, the residents'
association or other lawful means. They should make
every reasonable effort to ensure that the present
dispute does not give rise to further confrontation or
hostility. Peaceful coexistence requires not the
absence of disagreement, but the willingness to
resolve disagreement without resorting to aggression
or violence.
23. For the foregoing reasons, this Court finds no ground
to quash the criminal proceedings at this stage. Both
criminal petitions are accordingly dismissed .
