the IPC.
2. The prosecution story, in brief, is that complainant Shakeel
Qureshi had obtained a housing loan of Rs.12,00,000/- from Cent
Bank Home Finance Limited against mortgage of his property
situated at Torwa, Bilaspur. It is alleged that the complainant
made certain payments towards his loan account and that out of
the total alleged payment of Rs.7,35,000/-, an amount of
Rs.2,75,000/- was reflected in the loan account, whereas the
remaining amount of approximately Rs.4,60,000/- was allegedly
not credited. It is further alleged that the said amount was
misappropriated by the applicant, who was working as Branch
Manager, in connivance with co-accused Nitin Nigam. On the
basis of the aforesaid allegations, Crime No.375/2026 came to be
registered against the applicant and co-accused for the offences
punishable under Sections 420/34 of the Indian Penal Code.
Hence, the bail application.
3. Learned counsel for the applicant submits that the applicant is
innocent and has been falsely implicated in the present case. He
further submits that the FIR does not contain any specific
allegation that the complainant ever personally paid or handed
over the alleged amount of Rs.4,60,000/- to the applicant. The
allegation against the applicant is founded upon an alleged
discrepancy in the loan account and alleged non- credit of certain
payments. The entire prosecution case is predominantly
documentary in nature. The alleged payments, receipts, vouchers,

DD, loan account entries, ledger records and other banking
documents are all capable of being verified from the records of
the Bank and are not dependent upon custodial interrogation of
the applicant. The applicant was working as the Branch Manager
of Cent Bank Home Finance Limited and the mere fact that
certain documents bear her official signatures cannot, by itself,
establish that she dishonestly received or misappropriated the
alleged amount. The prosecution is required to establish a specific
overt act and the necessary dishonest intention attributable to the
applicant. Moreover, co-accused has already been released on
anticipatory bail vide order dated 6.8.2026 passed in MCRCA
No.1274/2026. Therefore the applicant be released on bail.
4. On the other hand, learned State counsel and learned counsel for
the Objector oppose the prayer for grant of anticipatory bail to the
applicant.
5. I have heard learned counsel for the parties and perused all of the
documents taken on record.
6. Considering the facts and circumstances of the case, and the fact
that co-accused has already been released on anticipatory bail
by this Court vide order dated 6.8.2026 passed in MCRCA
No.1274/2026, as such, this Court is inclined to extend the benefit
of anticipatory bail to the applicant.
7. Accordingly, the instant MCRCA is allowed and it is directed that
in the event of arrest of the applicant – Aparna Vishwas , on

(b) She should not act in any manner which will be
prejudicial to fair and expeditious trial.
(c) She should appear before the trial Court on each
and every date given to him by the said Court till
disposal of the trial.
(d) The Applicant and the sureties shall submit a copy
of their adhaar card alongwith a colored postcard full
size photo having printed the adhaar number on it, which
shall be verified by the trial Court.
(e) She should not involve herself in any offence of
