1. The applicants have filed the present Original Application under
Section 19 of the Administrative Tribunals Act, 1985 seeking the
following reliefs: -
a) Allow the original application and direct the respondents to
compliance of Govt. Order No.1212 of 2021 dated 15-11-2021
in full-fledged in case of the applicants at par with other
employees.
b) Allow the original application and direct the respondents for
compliance of Govt. Order No. 675- JK(GAD) of 2025 dated
06-06-2025 so far at is pertains to School Education
Department and were appointed prior to 31-10-2019 against
District Cadre (General Line Teacher) of Leh/Kargil and could
have been considered to be adjusted in the Union Territory of
Jammu and Kashmir in the appropriate service and cadre.

c) Consideration of the representation to redress the genuine
grievances of the applicants for their repatriation from the
Union Territory of Ladakh to Union Territory of Jammu and
Kashmir.
d) Pass any or other order(s) as this Hon'ble Tribunal deems fit
and proper, in the facts and circumstances of the case.
2. The applicants have filed the present Original Application seeking,
inter alia, a direction to the respondents to consider their cases for
repatriation from the Union Territory of Ladakh to the Union
Territory of Jammu & Kashmir. It is their case that they are domiciles
of the Union Territory of Jammu & Kashmir and were appointed as
General Line Teachers in the districts of Leh/Kargil prior to
reorganization. They rely upon Government Order No. 1212-
JK(GAD) of 2021 dated 15.11.2021, issued pursuant to Section 89(2)
of the Jammu and Kashmir Reorganization Act, 2019, as also
subsequent communications/orders concerning repatriation of
employees.

3. The applicants submit that despite having submitted
representations/options before the competent authorities, their
grievance regarding repatriation has remained pending. They have,
therefore, approached this Tribunal seeking consideration of their
cases by the respondents.
4. During the course of hearing, Sh. Raghu Mehta, learned Senior
Central Government Standing Counsel appearing for the respondents,
submitted that the applicants shall be repatriated to the Union
Territory of Jammu & Kashmir in a phased manner, in accordance
with the applicable policy and administrative requirements.
5. In view of the aforesaid statement made by learned Senior CGSC, no
useful purpose would be served by keeping the present Original
Application pending.
6. Having regard to the nature of the grievance and without entering into
the merits of the claims raised in the Original Application, we deem it
appropriate to dispose of the matter at this stage by directing the
competent authority to consider the applicants’ grievance in

accordance with the applicable rules, Government orders, guidelines
and policy governing the field.
7. Accordingly, the present Original Application itself shall be treated as
a representation on behalf of the applicants. The competent authority
amongst the respondents shall consider the same, along with the
documents annexed thereto and the relevant Government
orders/guidelines, and take an appropriate decision thereon by passing
a reasoned and speaking order, in accordance with law, within a
period of six weeks from the date of receipt of a certified copy of this
order.
8. It is made clear that this Tribunal has not expressed any opinion on
the merits of the claim of the applicants, and the competent authority
shall consider the matter independently in accordance with the
applicable rules and policy.
9. With the aforesaid directions and taking note of the statement made
by learned Senior CGSC regarding phased repatriation of the
