9. Based on the aforementioned compromise,
counsel for the respondent-husband also submits that the
appellant had agreed to withdraw the present appeal.
10. Counsel for the appellant submits that since the
date of the compromise, the appellant is not contacting
her and is not showing any interest in prosecuting the
appeal. She further submits that in spite of her requests,
the appellant has not come forward to sign the memo of
withdrawal prepared by the counsel for the appellant.
11. As can be seen from the memo of compromise,
though it substantially settles the issue of maintenance
between the parties concerned, it does not speak anything
about the intention of the appellant to withdraw the
appeal. However, taking into consideration the submission
made by the learned counsel for the appellant and the
conduct of the appellant, it has to be inferred that she is
not interested in prosecuting the appeal.

12. Even otherwise, we do not see any error in the
impugned judgment of the Family Court.
13. Based on the evidence let in by the parties, the
Trial Court has come to the conclusion that the appellant-
wife and her relatives used to unnecessarily quarrel with
the respondent-husband and used to abuse him in filthy
language. It has also come to the conclusion that the
appellant-wife had made a false allegation of adultery
against the respondent-husband, and also that she had
falsely alleged instances of harassment against her
husband and his family members. The said acts, under the
circumstances, have to be considered as cruelty towards
the respondent-husband.
14. On a perusal of the evidence let in by the
parties, in our opinion, it establishes the aforementioned
facts and there is no reason as to why the conclusion
arrived at by the Family Court has to be interfered with.
