THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227
OF THE CONSTITUTION OF INDIA, PRAYING TO ISSUE A WRIT IN

PETITION AND ETC.
THIS WP COMING ON FOR PRELIMINARY HEARING, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE M.G.S. KAMAL
ORAL ORDER
1. Petitioners, who are defendants in O.S.No.135/2025 are
before this Court being aggrieved by the order passed by
the First Appellate Court in M.A.No.35/2026 dated
16.09.2026, in terms of which the First Appellate Court
while allowing the appeal filed by the
plaintiffs/respondents, restrained the petitioners herein
from interfering and causing obstructions on the 10 feet
wide mud road lying on the southern side of Sy.No.255
till disposal suit.
2. It is the case of the plaintiffs that there exists 10 feet
wide road on the southern side of the land bearing

Sy.No.255 connecting to their property in Sy.No.254 and
to the road lying on the eastern side called as Shiddapur
Chikkanaragund Road.
3. It is their case that except that road, they have no other
road and they have been using the said road for over
several years. Trial Court however referring to a sketch
produced by the defendants which indicates the existence
of a Nala on the northern extreme end of the property of
the defendants, has come to the conclusion that there
exists alternate access to the property of the plaintiffs
and the suit being one for easement of necessity, they
cannot claim it as a matter of convenience and
accordingly rejected the application. As against which an
appeal was filed by the plaintiffs in M.A.No.35/2026.
4. The First Appellate Court re-appreciating the plaint
averments has found that the road being claimed by the
plaintiffs at paragraph No.7 of their plaint as extracted
above is the only access they have therefore passed the
interim order. Assailing this order, this present petition.

5. Learned counsel for the petitioners referring to paragraph
No.4 of the order passed by the First Appellate Court,
submits that, it is the specific case of the plaintiffs that
there existed a 10 feet road on the eastern side of the
land in Sy.No.252. Therefore, even according to the
plaintiffs and even as taken note of by the First Appellate
Court, there exists a 10 feet wide road on the eastern
side of land bearing Sy.No.252. Therefore, granting
interim relief, restraining the defendants from causing
obstruction to the plaintiffs to utilize the road on the
southern side of the property of the defendants is
irregular, unsustainable.
6. Learned counsel for petitioners/defendants also produced
a memo along with the sketch and certain photographs to
indicate that there exists a road alongside the Nala on the
northern side, which connects to the other road shown in
the sketch as Malaprabha Kaluve road which can be
accessed by the defendants. Therefore, he submits that
in a suit for easement of necessity, the plaintiffs having
alternate road cannot as a matter of right claim access

through the property of the defendants which has not
been taken note of by the First Appellate Court. Hence,
seeks for allowing of the petition.
7. Per contra, learned counsel for the respondents referring
to the photographs produced along with the memo
submits that the Nala being shown in the hand sketch
produced by the petitioners cuts across the road
alongside the Nala without providing any access to the
land of the plaintiffs. He specifically refers to page Nos.7
and 8 of the memo to contend that the obstruction of the
Nala through the road alongside the Malaprabha Kaluve
Road is visible from the photographs disconnecting the
land of the plaintiffs from the main road. He submits
reading of paragraph No.4 of the order passed by the
First Appellate Court is incorrect as it does not take into
consideration the actual pleading of the plaintiffs. Hence,
seeks for dismissal of the petition.
8. Heard. Perused the records.
9. The above suit in O.S.No.135/2025 has been filed by the
plaintiffs seeking following reliefs:

11. Perusal of the aforesaid paragraphs of the plaint indicate
that it is a specific case of the plaintiffs that there exists
10 feet wide road on the southern side of the property of
the defendants in Sy.No.255 connecting to their property
in Sy.No.254, which has been in existence over several
years.
12. The vehement submission of the learned counsel for the
petitioners referring to the contents of paragraph No.4 of
the order passed by the First Appellate Court is that there

exists road on the eastern side, appears to be
misconceived.
13. Paragraph No.4 of the First Appellate Court order reads
as under:
“4. It is further specific case of plaintiff that, there is a
10 feet width road existing since more than 100 years
and same is running about 2 K.M. i.e., up to irrigation
canal located at the eastern side of Sy.No.252 (herein
after referred as disputed road). The appellants and
their predecessor approach their agricultural lands
mentioned above by using the said 10 feet road on
the Southern side of lands bearing Sy.No.253,
Sy.No.254 and Sy.No.255. Ancestors of appellant's
are using said road to approach their lands to
transport the agricultural requirements without
obstructions of any person since more than 100 years.
The said road is essential for appellant's to connect
and approach the main road as an easement of
necessity. It is further averred that, the respondents
are very well aware about this fact that appellant and
their predecessors have been continuously using the
said land for more than 100 years without any
hindrance or interruptions. Now the respondents in
order to harass appellants, on 15.11.2025 obstructed
them from passing through the said 10 feet width
road.”
14. Though paragraph No.4 of the First Appellate Court refers
to a purported existence of road on the eastern side to be
the one referred to by the plaintiff, what the said
paragraph misses out is specific averment made in
paragraph No.4 of plaint “ ದ-b ಣ >ೕ \ಂಟ c 10 Z_

”. This southern end direction is missed out in

appreciation of material on record, has granted the relief
as sought for. Therefore, that portion of the order cannot
be read to mean that there existed another road. The
order passed by the First Appellate Court cannot be
interfered with. In any event said reasoning and opinion
is only prima facie for the purpose of granting interim
relief.

before the Trial Court seeking appointment of a
Commissioner regarding existence of alternate road, if
any. If there exists an alternate road, parties are at
liberty to bring to the notice of the Court and seek
modification of the order in accordance with law.
17. There is an allegation that the plaintiffs by virtue of the
order granted by the First Appellate Court attempting to
destroy the standing crop of the defendants, which is
stoutly denied by the learned counsel for the plaintiffs. He
further submits that no such action would ever be
