JUDGMENT:
1. This is an application seeking directions to provide adequate
Police Personnel for maintaining security to facilitate the peaceful
performance of ‘Ka Leh Niam Iewduh’, which was initially scheduled on
05.11.2026. It appears that the instant Misc. Case has been occasioned
with regard to the question of collection of voluntary contributions from
Iewduh, which goes towards the conduct of rituals.
2. Mr. N. Syngkon, learned counsel for the
petitioners/applicants submits that as per customs, it is the
Lyngdoh/applicant who undertakes the collections, accepts the
contributions and issues receipts thereon, whereas the respondents Nos. 3
& 4, maintain that the collections are carried out by the person authorized
by the Dorbar of the respondent No. 3. Further, it is noted that certain
allegations have been made by the applicants that in the conduct of the
earlier rituals at ‘Lum Shyllong’, though amounts were released by the
respondent Nos. 3, and the same was received by the respondent No. 8, as
Page 3 of 6
2026:MLHC:1248
Secretary, no amount was disbursed to the Lyngdoh for the expenses
incurred in the conduct of the rituals. However, Mr. K. Paul, learned
Senior counsel assisted by Mr. R.K. Synrem, learned counsel for the
respondent No. 4, submits that the amounts so received from the
respondent No. 3, had been in fact used for the rituals.
3. As these issues cannot be determined by this Court, the same
are not dwelt upon.
4. Coming to the issue in hand, it appears that pursuant to the
order dated 14.10.2026, the respondent No. 3, had accordingly convened
a Dorbar on 27.10.2026, for confirming or rescheduling the date for ‘Leh
Niam Iewduh’, and further, to ensure that Raid Mylliem, as undertaken to
bear the expenses, or in the alternative, the situation permitting, to allow
the acceptance of voluntary contributions by the Lyngdoh, in order that
the religious rites which is sacred and important, be conducted in a
peaceful and befitting manner.
5. Mr. L. Khyriem, learned counsel for the respondent No. 3,
submits that in the Meeting that was held, where the date was rescheduled,
the Lyngdoh had come along with 3 or 4 other people, who are not Myntris
to attend the Dorbar, and on an objection being raised, had left the
Meeting, and returned only after the date had been fixed by the Dorbar.

6. A transcript of the proceedings has been examined by this
Court. It appears that the Meeting had not reached an amicable resolution,
due to the presence of the 3 persons who had accompanied the Lyngdoh,
including the petitioner No. 2, in the main writ petition. To the mind of
the Court this fact is mild in nature, inasmuch as, in Para-7 of the Judgment
itself, this Court expected that all the parties concerned extend their
cooperation in this regard, and as such there should be no difficulty if the
members were there, to observe the proceedings. However, as the date has
since been fixed on 29.11.2026, it is expected that the parties will
cooperate and agree to the date so fixed. With regard to the manner of
collection of the donations, the respondent No. 3, shall issue appropriate
orders to designate either the representative of 5 Kur 11 Kur or the
Lyngdoh, who shall accept the voluntary contributions. The amount so
collected shall be recorded, and receipts be obtained for such
contributions, and to ensure that the same goes toward the expenditure to
be incurred for the rituals.
7. On another aspect that has been submitted by Mr. N. Syngkon,
learned counsel for the petitioners/applicants that a List of persons to
perform the rituals will be provided to the Syiem of Mylliem, before the
15.11.2026, from the side of the respondent No. 3, it is submitted that the
Page 5 of 6
2026:MLHC:1248
same will be accepted and examined. The respondent No. 4, also shall
submit their list, and the respondent No. 3 (Syiem) shall make appropriate
orders thereon, after due consideration, of all the names submitted by the
petitioners and the respondent No. 4.
8. Misc. Case accordingly stands disposed of.
