Order on Board
16.10.2026
1. Since a common question is involved in all these writ petitions, they
are being taken up together and disposed of by this common order.
2. By filing these writ petitions, the petitioners have assailed the common
impugned order dated 05.08.2021 (Annexure P/1), whereby
respondent No. 2 directed that the subject lands be recorded in the
names of respondents No. 5 and 6, without issuing notice to the
petitioners or affording them an opportunity of hearing, despite the
lands having been mutated in their names.
3. No one appears on behalf of the petitioners to press these writ
petitions despite repeated calls.
4. Learned counsel appearing for respondents No. 5 and 6 submits that
the dispute between the parties has already been settled amicably and
a compromise deed has been executed before the competent Civil
Court. He further submits that, on the basis of the said compromise,
Civil Suit No. 43-A/2021 has been disposed of by the learned Civil
Court vide judgment and decree dated 01.09.2026. In view of the
settlement arrived at between the parties and the subsequent disposal
of the civil suit, nothing further survives for consideration in the present
writ petitions.
5. The relevant portion of the judgment and decree passed by the
learned Civil Court, on the basis of the compromise application filed
4
under Order XXIII Rule 3 of the Code of Civil Procedure, 1908, is
reproduced hereinbelow for ready reference:
“It is ordered and decreed that

-
पारित की जाती है
1.

6. Having considered the submissions advanced by learned counsel
appearing for respondents No. 5 and 6 and upon perusal of the
5
judgment and decree dated 01.09.2026 passed in Civil Suit No.
43-A/2021 as also the decree, it is evident that the dispute between
the parties concerning the subject land has been settled, to the extent
recorded in the compromise decree, by the competent Civil Court. In
view of the settlement and the subsequent disposal of the civil suit, no
further adjudication in these writ petitions is warranted, and nothing
survives for consideration.
7. Accordingly, all these writ petitions are disposed of as having been
rendered infructuous.
8. There shall be no order as to costs.
