ORAL ORDER

1. This writ petition is filed under Articles 226 and 227
of the Constitution of India, seeking a writ of certiorari or any
other appropriate writ, order or direction to quash the order
dated 16.07.2026 passed by respondent No.1 in Revision
Petition No.23/2026, produced as Annexure-F, and for such
other reliefs as this Court deems fit to grant in the
circumstances of the case.

2. The petitioner herein is defendant No.1 in O.S.
No.349/2022 filed by respondent Nos.8 and 9 herein. The
dispute relates to the revenue proceedings in respect of land
bearing Survey No.152, measuring 2 acres, situated at Vipra
Village, Gangavathi Taluk, Koppal District.

3. The said land originally belonged to one Kottrappa,
who passed away leaving behind his wife, Hampamma.
Hampamma had a daughter by name Mangalagouri, who was
given in marriage to one Mallikarjuna. The said Mangalagowri
passed away issueless. Hampamma is stated to have arranged
the second marriage of Mallikarjuna with one Renukamma. The
petitioner herein is the son of the said Renukamma.

4. Hampamma inherited several immovable properties
owned by her husband, Kottrappa. Hampamma is stated to
have passed away on 01.11.2022, leaving behind a registered
Will dated 12.02.2016, bequeathing her properties in favour of
the petitioner herein, his brothers and other relatives.

5. In the meanwhile, respondent Nos.8 and 9 herein,
claiming to be the children of Kottrappa through his second
wife, filed the aforesaid suit seeking partition and separate
possession of the properties originally belonging to Kottrappa.
Upon the demise of Hampamma, the petitioner and other
beneficiaries under the aforesaid Will were brought on record as
defendants in the said suit.

6. In the meanwhile, the petitioner herein sought
mutation of his name in respect of the land bearing Survey
No.152, measuring 2 acres, on the basis of the aforesaid
registered Will. The Tahsildar mutated the name of the
petitioner in the revenue records. In R.R.T. Appeal
No.107/2025, the Assistant Commissioner directed continuation
of the revenue entries, subject to the outcome of the suit in
O.S. No.349/2022.

7. Being aggrieved by the said order, a revision
petition was preferred before the Deputy Commissioner under
Section 136 of the Karnataka Land Revenue Act, which came to
be allowed, setting aside the orders passed by the Tahsildar
and the Assistant Commissioner and directing cancellation of
the revenue entries made in the name of the petitioner. Being
aggrieved by the same, the petitioner has filed the present
petition.

8. Learned counsel for the petitioner submits that the
revenue entries in respect of the land bearing Survey No.152
were effected in the name of the petitioner on the basis of the
registered Will and that the said property is not the subject
matter of the suit in O.S. No.349/2022. He further submits that
the appeal and revision were not filed by respondent Nos.8 and
9, but by the brothers of Kottrappa, who are not parties to the
said suit. Therefore, he contends that respondent Nos.8 and 9
locus standi
have no to seek cancellation of the petitioner's
name in the revenue records. Accordingly, he seeks allowance
of the petition.

9. Learned counsel appearing for respondent Nos.8
and 9, drawing the attention of this Court to the schedule of
properties in the Will as well as the schedule to the plaint,
submits that all the properties which are the subject matter of
the suit are also covered under the Will, except the property
bearing Survey No.152, which was omitted due to oversight.
She submits that an application in this regard is being filed in
the pending suit.

10. As regards the challenge before the Assistant
Commissioner, learned counsel submits that, though the appeal
was filed by the brothers of Kottrappa, respondent Nos.8 and 9
were also arrayed as parties therein. The brothers of Kottrappa
are supporting the cause of respondent Nos.8 and 9. She
further submits that, since the properties covered under the
Will are being considered in the pending suit, the order passed
by the Deputy Commissioner would not cause any prejudice to
the petitioner.

11. Heard learned counsel for the parties and perused
the records.

12. There is no dispute that the properties originally
belonged to Kottrappa and, upon his demise, were inherited by
Hampamma. There is also no dispute that Hampamma
executed a registered Will bequeathing the properties in favour
of the petitioner herein and other beneficiaries referred to
therein.

13. There is also no dispute that respondent Nos.8 and
9 have filed a suit in O.S. No.349/2022, claiming to be the
children of Kottrappa through his second wife. Kottrappa
admittedly passed away in the year 2008, and the name of
Hampamma was mutated in the revenue records in the same
year. There was no challenge to the said entries or any claim
raised by respondent Nos.8 and 9 until the year 2022.

14. The Will was executed in the year 2016, and
Hampamma passed away on 01.11.2022. The proceedings
before the revenue authorities were initiated within one month
of the filing of the suit, not by respondent Nos.8 and 9, but by
the alleged brothers of Kottrappa.

15. On a further query by this Court, learned counsel
submits that mutation entries have also been effected in favour

of the beneficiaries in respect of other properties covered under
the Will, and there is challenge to the said mutation entries, as
well.

16. From the aforesaid facts, what emerges is that the
claim in respect of the properties of Kottrappa has been raised
after about fourteen years of his demise by persons claiming to
be the children of his second wife. The land bearing Survey
No.152, measuring 2 acres, in respect of which the petitioner's
name has been mutated, is one of the properties covered under
the Will. The said Will is also the subject matter of the suit in
O.S. No.349/2022.

17. Respondent No.1, taking into consideration the
aforesaid facts, has passed the impugned order. The relevant
portion of the said order reads as under:
