(GJHC240780952026)
8. In rebuttal, learned counsel for the petitioners-accused submitted
that in view of the compromise arrived between the parties, no purpose
would be served by proceeding with impugned FIR and the Criminal
Case and argued that it would amount to abuse of process of law. In
support of his contentions, he has relied upon the judgments of the
Hon’ble Apex Court in the cases of Gian Singh Vs. State of Punjab
& Anr. , reported in (2012) 10 SCC 303 , Madan Mohan Abbot Vs.
State of Punjab , reported in (2008) 4 SCC 582 , Nikhil Merchant
Vs. Central Bureau of Investigation & Anr. , reported in 2009 (1)

reported in 2014 (2) Crime 67 (SC) as well as State of Haryana
Vs. Bhajanlal reported in AIR 1992 SC 604.
9. Having considered the submissions of the learned counsels for
the parties and having gone through the records, it appears that FIR
being C.R.No. 11191041260797/2026 came to be registered before
Sherkotda Police Station, Dist. Ahmedabad for the offences punishable
U/s 324(4), 296(B), 351(3), 331(6) & 54 of the BNS, 2023. However,
now the matter has been amicably settled between the parties.
Respondent No.2 – complainant has also filed her affidavit, thereby
admitting the settlement. Para Nos.2 to 6 of the said affidavit reads
thus:-
“2. That I am Respondent no.2 (Original Complainant) of
an FIR filed before Sherkotda Police Station vide I-

the criminal proceedings in relation to the impugned FIR against the
petitioner would be an unnecessary harassment to the petitioner.
Further trial would be a futile exercise and continuing with the criminal

amount to abuse of process of law. Hence, to secure the ends of
justice, the impugned FIR as well as the proceedings of the Criminal
Case, and all other consequential proceedings arising therefrom are
required to be quashed and set aside.
