1. These writ petitions pertain to affairs of a Society known
and called as Sri Jagadguru Shivananda Vidyavarthaka
Samsthe by two rival groups, one led by Shree Jagadguru
Abhinava Shivananda Mahaswami (hereinafter referred to
as “Senior Pontiff” for short) another group led by Shri
Jagadguru Sadashivananda Bharathi Swamy (hereinafter

3. Brief facts leading to filing of all these petitions are that
Shri Jagadhuru Sivananda Math (hereinafter referred to as
“Math” for short), situated at Gadag has established
several educational institutions. For the purpose of
management of the said educational institution, aforesaid

society, namely, “Sri Jagadguru Shivananda Vidyavarthaka
Samsthe” (hereinafter referred to as “Society” for short)
has been registered under the provision of Karnataka
Societies Registration Act, 1960 (hereinafter referred to as
the “Act”).
4. In terms of the bye-laws of the Society, Peethadhikari of
the Math, automatically becomes permanent president of
its Managing Committee. The other members of the
committee would either be elected or nominated. That the
election to the Managing Committee of the said Society
was held on 25.11.2019 for a period of 5 years. Senior
Pontiff being the Peethadhikari was the president of the
society.
5. The Senior Pontiff of the Math had appointed Junior Pontiff
as Uttaradhikari of the Math, who was to succeed to the
post of Peethadhikari upon demise of Senior Pontiff.
6. Dispute arose a year later, when apparently the Junior
Pontiff claiming to have been appointed as Peethadhikari,
attempted to take over the affairs of the Society, declaring

himself as the Chairman of the Society. Junior Pontiff had
submitted the annual reports to respondent No.1/District
Registrar of Societies, which was accepted on 27.10.2020.
This was challenged by certain members by filing a writ
petition in W.P.No.101346/2021. The said writ petition
came to be allowed and the matter was remanded for
fresh consideration after hearing both the parties.
7. Upon the remand instead of enquiring into the matter
under Section 13, an enquiry under Section 25 of the Act
was initiated. Being aggrieved by which another writ
petition was filed in W.P.No.102372/2021, which was
disposed of directing conduct separate enquiries under
Sections 13 and 25 of the Act.
8. Thereafter, the District Register passed an order upholding
its earlier order dated 27.10.2020 accepting the returns
submitted by the Junior Pontiff. This has been challenged
in W.P.No.104067/2021. In which, an interim order is
granted against acceptance of the report submitted by the
Junior Pontiff.

9. In the meantime, appointment of Junior Pontiff as
Uttaradhikari was cancelled by the Senior Pontiff, which
has been questioned by the Junior Pontiff by filing a suit in
O.S.No.4/2023. In the said suit, an application seeking
interim order of injunction was sought restraining Senior
Pontiff and the disciples from preventing Junior Pontiff in
discharging his duties and functioning as Peethadhikari.
The said application came to be rejected by the Trial Court,
which rejection has been confirmed in the miscellaneous
appeal. Challenging the same, Junior Pontiff had filed writ
petition in W.P.No.107781/2023. The said writ petition was
partly allowed with a clear direction that Junior Pontiff
could participate only in the religious activities and affairs
of the Math as a devotee and shall not claim any right or
authority as Uttaradhikari. The said order further
restrained Junior Pontiff from doing any act which would
disturb the peace and management or affairs of the Math.
10. Despite the said order, it is alleged that the Junior Pontiff
continued to represent himself as the Chairman of the
Society and filed returns under Section 13 of the Act.

11. That the original term of the Committee which was
constituted on 25.11.2019 was due to expire during the
year 2024-25 requiring conducting of fresh election.
Accordingly the Senior Pontiff declared the elections and
appointed the Returning Officer. Appointment of the
Returning Officer was accepted by the District Register.
The elections were conducted as per the schedule fixed on
29.07.2025, results were declared which were submitted
to the District Registrar.
12. Simultaneously Junior Pontiff and his group also claim to
have conducted the meeting and elected a separate
committee of members in a meeting that was held
pursuant to the notice dated 16.11.2024 and submitted
their returns to the Registrar. This led to the filing of writ
petition in W.P.No.106530/2025 by the member of a group
belonging to Senior Pontiff. In which an interim order has
been granted directing the Registrar not to accept the
returns filed by the Junior Pontiff till completion of the
election.

13. In the aforesaid background, two returns of the society
came into existence. One headed by the Senior Pontiff,
which is dated 10.10.2025 and another headed by the
Junior Pontiff dated 06.08.2025 and 25.09.2025.
14. By the impugned communication dated 23.01.2026
produced as per Annexure-A in W.P.No.100839/2026, the
Registrar has rejected the returns filed by the Senior
Pontiff while he has accepted the returns submitted by the
Junior Pontiff as per the communication dated 22.01.2026.
15. It is these communications which have resulted in filing of
writ petitions. Rejection of the returns filed by the Senior
Pontiff has resulted in filing of writ petitions bearing
W.P.No.100839/2026. Acceptance of the returns filed by
the Junior Pontiff has resulted in filing of writ petition
No.W.P.No.100945/2026.
16. Challenging the appointment of election officer and the
election process at the instance of the Senior Pontiff, writ
petition in W.P.No.106530/2025 is filed by the Junior
Pontiff.

17. Heard learned Senior Counsel Sri Jayakumar S. Patil for
Smt.Vidyavati, M.Kotturshettar, counsel appearing for the
Senior Pontiff and his group and Sri Shivaraj S. Mudhol,
learned counsel appearing for the Junior Pontiff and his
group.
18. Learned Senior Counsel for the petitioner draws attention
of this court to the order dated 23.04.2024 passed by the
Co-ordinate Bench of this Court in W.P.No.107781/2023,
which was filed by the Junior Pontiff, being aggrieved by
rejection of his request for grant of interim order in the
suit filed by him in O.S.No.4/2023 and M.A.No.2/2023. He
points out to the operative portion of the said order which
reads as under:
“Under above circumstances, Writ Petition is
allowed in part, impugned order dated 15.02.2023
passed by Additional Senior Civil Judge, Gadag, in
M.A.no.2/2023 and order dated 19.01.2023 passed by
Principal Civil Judge and JMFC, Gadag in
O.S.no.4/2023 on I.A.no.2 are quashed.
I.A.no.2 filed by petitioner-plaintiff under Order
XXXIX Rule 1 and 2 of CPC stands allowed in part only
to extent of permitting plaintiff to continue as
'Uttaradhikari' of Math and claim of plaintiff about his
anointment as Mahant-Peethadhikari of Math as well
as its denial and claim of defendant of having
cancelled appointment of plaintiff as 'Uttaradhikari'
subject to final outcome of suit.

It is clarified that relief on I.A.no.2 is limited to
claim of status as 'Uttaradhikari' nominally, occupy
room in Math as earlier and participate in religious
activities/affairs of Math as a devotee only and refrain
from doing any act whatsoever that would disturb
management of affairs of Math peacefully etc. Both
parties shall maintain status quo as above until
disposal of suit.”
19. Referring to the said order learned Senior Counsel
emphatically submitted that the issue with regard to the
appointment of Junior Pontiff and his self-declaration of
he having been appointed as the Peethadhikari of the
Math is seized and pending consideration in the said suit.
That as long as the said issue is pending determination,
Junior Pontiff cannot claim any benefit whatsoever
including becoming office bearer of the Society. He
further submits, in terms of the direction issued by this
Court in the aforesaid order, except participating in the
religious ceremonies as a normal devotee, the Junior
Pontiff cannot participate in any of the management and
administrative affairs either of the Math or of the Society.
Therefore, he submits that the Registrar has grossly
erred in accepting the returns filed by the Junior Pontiff

claiming himself to be the Chairman of the said Society
which runs contrary to the order passed by this Court.
20. On the contrary, learned counsel Sri Shivaraj Mudhol,
appearing for the Junior Pontiff submits that the issue
with regard to the Math is different than the issue
pertaining to the Society. Both cannot be mixed up. He
submits, Junior Pontiff was elected as a Chairman of the
Society in a general body that was held and he was
unanimously elected as its Chairman. So it is in the
capacity of he being the Chairman being elected in the
general body of the society, he had submitted the returns
before the Registrar.
21. Pointing out to the impugned communication he submits
since the returns submitted by the Senior Pontiff were
defective in that there was no returns submitted for the
previous three years the Registrar has declined to accept
the same. Therefore, rejection of the returns submitted
by the Senior Pontiff cannot be found fault with.

22. On the other hand, returns submitted by the Junior
Pontiff were in compliance with the requirement of law as
such the same has been accepted. Therefore, no fault can
be found in Registrar accepting the returns.
23. On a query by this Court as to whether the Junior Pontiff
was appointed to be the Chairman of the society in his
capacity as Peethadhikari or in the capacity of he being a
member of the society, Sri Shivaraj P. Mudhol learned
counsel points out to Sl. No.16 of the list of members
produced at page 69 in W.P.No.107065/2025, and
submits that it is in the capacity of its member.
24. Learned Additional Advocate General, submits that the
Registrar has acted upon the representations made by
the respective groups and the returns filed by them. He
submits that should there be a dispute with regard to the
very enrollment of membership, parties shall be relegated
to the Civil Court to adjudicate and establish their
respective rights.

26. Question whether the Junior Pontiff has been appointed
as the Chairman of the society in his capacity as
Peethadhikari or as a member of the society goes to the
root of the dispute. Inasmuch as admittedly according to
the bye-laws of the Society, Peethadhikari of the Math
becomes a Chairman of the society by default. If, claim of
the Junior Pontiff that he has been appointed as the
Chairman of the society in his capacity as Peethadhikari,
the said claim of him being Peethadhikari is pending
consideration in the suit in O.S.No.4/2023. As noted
above, he has been restrained from representing himself
as Peethadhikari of the Math by this Court in the order
passed in W.P.No.107781/2023 extracted herein above.
27. Cumulative effect of these orders and pendency of the
suit is that Junior Pontiff can neither represent himself as
a Peethadhikari of the Math nor can he participate in the
affairs of the Math including the society in the said
capacity. The only other option for him to justify his claim
to be the Chairman of the Society is to establishing that

he is the member of the Society, and that he was elected
to the post of Chairman of the society as its member.
28. As already noted learned counsel appearing for Junior
Pontiff pointed out to the list of members of the society,
which indicates name of Junior Pontiff at Sl.No.16 of page
No.69. This factual aspect of the matter has been
seriously disputed by the counsel for Senior Pontiff.
29. If claim of the Junior Pontiff that he has been elected as
the Chairman of the Society in the capacity of its
member, then the scope of the dispute would be
different. Admittedly, two different elections to the
Managing Committee of the society have been conducted.
One led by Senior Pontiff another by Junior Pontiff. This
would give raise to consequential questions as to which of
these two elections should be given credence in the eye
of law. Whether or not such elections were indeed
conducted in accordance with law and statutory
requirements. These questions cannot be gone into in the
petition under Article 226 of the Constitution of India.
Therefore, these convoluted, complex factual

controversies requires to be adjudicated and determined
by competent authority in the manner know to law.
30. This Court under the circumstances deems it appropriate
to dispose of these writ petitions directing the respondent
No.1-District Registrar to enquire into the following
points:
(i) Whether the Junior Pontiff is the chairman of
the society in his capacity as the
Peethadhikari of the Math or as member of
the society? If he was elected in his capacity
as a member, the date on which he was
enrolled as a member of the society?
(ii) Whether the annual general meeting in which
the Junior Pontiff claims to have been elected
as a Chairman of the society was conducted in
accordance with the statutory requirements?
(iii) Similarly whether the annual general meeting
conducted by the Senior Pontiff was in
accordance with statutory requirements?
31. It is made clear during the enquiry if there is a serious
dispute with regard to the claim of Junior Pontiff being
member of the Society, the District Registrar shall

relegate the parties to the Civil Court for adjudicate upon
such dispute and their consequent rights and obligations
arising thereof.
32. The impugned communication dated 23.01.2026,
rejecting the report submitted by Senior Pontiff produced
at Annexure-A to the writ petition in WP.No.100839/2026
and the order dated 20.02.2025 produced at Annexure-A
to the writ petition in WP.No.100945/2026 shall be kept
in abeyance, till determination of the aforesaid issue by
the District Registrar.
33. The same shall be given effect subject to outcome of the
answers to the aforesaid points to be adjudicated by the
District Registrar.
34. The District Registrar shall hold an enquiry and conclude
on the aforesaid points within an outer limit of two
months from the date of receipt of the certified copy of
this order.
35. Parties are at liberty to submit such additional
documents, in support of their respective contentions.

36. The writ petitions are disposed of accordingly.
37. In view of disposal of the writ petitions, pending
applications, if any, do not survive for consideration and
the same are disposed of accordingly.
