Madhya Pradesh High Court

NEUTRAL CITATION NO. 2026:MPHC-GWL:26307
1 WP-43804-2025
IN THE HIGH COURT OF MADHYA PRADESH
AT GWALIOR

BEFORE
HON'BLE SHRI JUSTICE PAVAN KUMAR DWIVEDI
st
ON THE 1 OF SEPTEMBER, 2026
WRIT PETITION No. 43804 of 2025
VRINDAWAN SHARMA AND OTHERS
Versus
THE STATE OF MADHYA PRADESH AND OTHERS
Appearance:
None for the petitioners.
Shri Dharmendra Nayak - GA for the respondents/State.
ORDER
The present petition has been filed by the petitioners for the following
reliefs:-
"7.1 That, respondent authorities may kindly be directed to decide the representation annexure
P/1 forthwith.
7.2 That, respondent authority may kindly be directed to consider the case of petitioners and
awarded the compensation amount which was occurred due to Ola vrishti.
7.3 That, other relief doing justice including cost be ordered."
2. Short facts relevant for the purposes of deciding this case are that
the petitioners are agriculturists and their land is situated at Survey No. 197,
246/2, 247, total admeasuring 1.78 hectares, and Aaraji Survey Nos. 201,
248 and 207, total admeasuring 3.49 hectares.
3. The dispute regarding the title of the land in question is sub-judice

dispute as indicated in Annexure P/3, they are still in possession of the land

in question.
5. In the year 2023-24, there were hailstorms in the area where the
land of the petitioners is situated. Consequently, the crop cultivated by the
petitioners was destroyed. The petitioners, therefore, submitted a
representation seeking compensation for the damage suffered by them due to
the hailstorm. However, the respondents/authority have not taken any action
on the representation of the petitioners in terms of the Circular issued under
Revenue Book Circular, Block 6, No. 4, Schedule 1. The case of the
petitioners is that, irrespective of the dispute regarding the title of the land,
they are covered under the definition of a "bona fide agriculturist" and,
therefore, irrespective of the outcome of the title dispute pending
consideration before the competent Court, the petitioners ought to have been
granted compensation, as they were the persons who had cultivated the land
and whose crops were destroyed due to the hailstorm.
6. Learned counsel appearing for the State submits that, in view of the
fact that the State has already granted compensation to the bona fide owners
of the land in question, the petitioners are not entitled to compensation,
particularly when the petitioners have not impleaded the concerned persons
as party respondents in the present proceedings. It is, therefore, submitted
that the petition deserves to be dismissed on the ground of non-joinder of
necessary parties.
7. Heard learned counsel for the State and perused the case diary.
8. Considering the limited prayer made in the petition, and taking into

representation.

petitioners, an opportunity of hearing shall also be afforded to the
interested persons who have claimed title over the property in

iv. The outcome of the decision shall be communicated to
the petitioners as well as the contesting parties within the aforesaid
