COMMON ORDER
(Order of the Court was made by Dr.Anita Sumanth J.)
This is a batch of 13 writ petitions that may be broadly divided into two
sub divisions, 6 writ petitions, where this is the first round of litigation, and 7
writ petitions where this is the second round of litigation.
2.In the latter batch, convicts had sought premature release in terms of
G.O.Ms.No.488, Home (Pri-V) dated 15.11.2021 and the proposals sent by the
Director General of Prisons to the State Level Committee (Committee) had

WP.No.35730 of 2024 etc. batch
resulted in positive recommendations from the Committee for their early
release.
3.The recommendations had been forwarded to the Government for
confirmation, and the Government had rejected the requests for early release.
The orders of rejection came to be challenged before this Court in a batch of
writ petitions, and on a consideration of the rejection orders, this Court had
remanded the matters to the Government for re-consideration. The present
impugned orders have been passed by the Government rejecting the pleas for
early release, essentially on the ground that the offences committed by the
convicts related to heinous and brutal crimes as against women.
4.The first sub-batch of writ petitions relates to convicts whose pleas for
early release had been positively recommended by the Committee but that had
been rejected by the Government at the very first instance, on the ground that
the offences committed related to brutal and heinous crimes against women.
Since in effect, the challenge is identical across all writ petitions, the two sets of
matter have been consolidated for hearing before us.
5.We have heard Mr.M.Mohamed Saifulla, learned counsel for the
petitioners in W.P.Nos.35730 & 37673 of 2024, W.P.Nos.1890, 18278, 19077,
19555 & 19566 of 2025, WP.Crl.Nos.592, 1083, 1074, 1189 & 1481 of 2025,

7. The petitioners herein, either on their own behalf where they are the
convicts, or on behalf of their relatives who are convicts, in different prisons
across Tamil Nadu, have sought early release premised on G.O.Ms.No.488
Home, (Pri-V) dated 15.11.2021 (Government Order), issued under Article 161
th
of the Constitution of India on the occasion of the 113 Birthday of
Dr.Peraringnar Anna.
8. The Government Order enables the grant of premature release to life
convicts who have completed 10 years of actual imprisonment as on
15.09.2021. It is a settled position that the threshold of 10 years as stipulated
under the Government is only the pre-qualificatory requirement, and does not
vest any right of premature release on the convict. There are various conditions
set out in the Government Order that the convicts are required to satisfy, and
prisoners convicted for certain demarcated offences are ineligible for the benefit
under the Government Order.
9. One of the conditions relates to cruelty against women (Section 498A
IPC/dowry death (Section 304B IPC)).The petitioners make a tentative

suggestion that in many of the cases, neither Section 498A IPC nor Section
304B of IPC have been invoked. Rather, the offence has been of murder under
Section 302 and hence invocation of the bar under the G.O in their cases is
incorrect.
10. Per contra, the respondents argue that in a significant number of
cases, the reason for rejection of the plea was specifically the fact that the
convicts had committed gruesome, heinous and brutal offences against women.
The only exception is WP.No.37673 of 2024 wherein a 71 year old male doctor
had been kidnapped for ransom and thereafter murdered.
11. We have carefully considered the rival contentions and reject the
argument of the petitioners on this score. It would be a travesty of the
Government Order and the bar set out therein, to state that it is only cruelty as
per Section 498A or dowry death as per Section 304B, that would stand in the
way of early release. Evidently, the crime of murder of a woman stands on an
equal, or even greater pedestal than the two offences named in the Government
Order.
12. That apart, the case of the prosecution has been that the murders have
been carried out in a brutal and heinous manner. The appeal orders in the cases
of all convicts before us have attained finality and there is thus no dispute on the
factual matrix of the matters. In this light of the matter, we reject the argument

of the petitioner and note that offences committed by the convicts undoubtedly
attract the bar under the Government Order.
13. Having said so, the issue of early release, the circumstances in which
the plea should be considered and the manner of such consideration was the
1
subject matter of judgment of the Supreme Court in Joseph v State of Kerala .
In that case, the petitioner had been serving life imprisonment for offences
under Sections 302 and 392 IPC. At the time when he approached the State
Government, he had served actual imprisonment for about 26 years.
14. That petitioner’s case has been considered by the Advisory
Committee/Jail Advisory Board on nine occasions, of which, three times, the
Board had recommended his early release. The recommendations were to no
avail as the State Government proceeded to reject the request on all three
occasions. The stand taken by the State was that the conviction related to
offences against women and, as a policy, the Government would not accept the
plea of premature release in such cases.
15. The Court held that such a policy could not be countenanced as it
resulted in the blanket exclusion of certain offences from the grant of early
remission. Such a policy was, to quote the Court ‘not only arbitrary but turns
the ideals of reformation that run through our criminal justice system, on its
head.’

16. The basis of an order considering a plea for premature release thus
cannot be unitary in its consideration, proceeding solely on the nature of
offences committed by the convict, but has also to take into account the aspects
of their reformation and rehabilitation. This is what the judgment in Joseph has
to say, on that account:
‘Numerous judgments of this court, have elaborated on the
penological goal of reformation and rehabilitation, being the
cornerstone of our criminal justice system, rather than
retribution. The impact of applying such an executive
instruction/guideline to guide the executive’s discretion would be
that routinely, any progress made by a long-term convict would
be rendered naught, leaving them feeling hopeless, and
condemned to an indefinite period of incarceration. While the
sentencing courts may, in light of this court’s majority judgment
in Sriharan (supra), now impose term sentences (in excess of 14
or 20 years) for crimes that are specially heinous, but not
reaching the level of ‘rarest of rare’ (warranting the death
penalty), the state government cannot – especially by way of
executive instruction, take on such a role, for crimes as it deems
fit.’
17. The Court, referring to Articles 72 and 162 of the Constitution in
matters of remission, commutation etc., says that those powers cannot be caged
in the form of guidelines that are inflexible. In fine, the conclusion is that
typecasting a convict through guidelines that are inflexible, based on crimes
committed by them in the past, may well result in the real danger of overlooking
the reformative potential of the individual. This point is best elaborated in the
words of the Court that reads as follows:-
‘33. Classifying - to use a better word, typecasting convicts,
through guidelines which are inflexible, based on their crime

committed in the distant past can result in the real danger of
overlooking the reformative potential of each individual convict.
Grouping types of convicts, based on the offences they were found
to have committed, as a starting point, may be justified. However,
the prison laws in India – read with Articles 72 and 161
- encapsulate a strong underlying reformative purpose. The
practical impact of a guideline, which bars consideration of a
premature release request by a convict who has served over 20 or
25 years, based entirely on the nature of crime committed in the
distant past, would be to crush the life force out of such individual,
altogether. Thus, for instance, a 19 or 20 year old individual
convicted for a crime, which finds 27 (2007) 13 SCC 606 place in
the list which bars premature release, altogether, would mean that
such person would never see freedom, and would die within the
prison walls. There is a peculiarity of continuing to imprison one
who committed a crime years earlier who might well have changed
totally since that time. This is the condition of many people serving
very long sentences. They may have killed someone (or done
something much less serious, such as commit a narcotic drug
related offences or be serving a life sentence for other nonviolent
crimes) as young individuals and remain incarcerated 20 or more
years later. Regardless of the morality of continued punishment,
one may question its rationality. The question is, what is achieved
by continuing to punish a person who recognises the wrongness of
what they have done, who no longer identifies with it, and who
bears little resemblance to the person they were years earlier? It is
tempting to say that they are no longer the same person. Yet, the
insistence of guidelines, obdurately, to not look beyond the red lines
drawn by it and continue in denial to consider the real impact of
prison good behaviour, and other relevant factors (to ensure that
such individual has been rid of the likelihood of causing harm to
society) results in violation of Article 14  of the Constitution.

any, shown of their past acts, assessment, if any, of whether, and how they
could contribute to society if released, perception of threat that they may pose to
society and other relevant parameters.
19. We find that while some of the petitioners before us have completed
over 10 years, some have served more than 11, 12, 15, 17 and even 20 years of
sentence, and it is necessary that a detailed assessment and evaluation, of the
above, and other relevant parameters be made in course of deciding the
applications for premature release. We are informed by the respondents that the
State is presently in the throes of formulating a policy specifically to deal with
early release in cases of convicts who have committed heinous crimes against
women.
20. Hence, we set aside the present impugned orders, permitting the
convicts to re-submit applications for premature release that will be considered
in line with applicable Government Orders read with the salutary principles
enshrined in Joseph’s case.
21. These writ petitions are allowed in terms of this order. Costs made
easy.
