The applicants are presently working as Primary Teachers (PRTs) under the
Respondent, Kendriya Vidyalaya Sangathan (KVS), and seek consideration for
promotion to the post of Headmaster through the Departmental Promotion
Committee (DPC).
2. There are two modes for filling up the post of Headmaster in KVS, namely,
promotion and Limited Departmental Examination (LDCE). The Recruitment
Rules framed in 2012 and revised in 2014 provided for filling up the post in the
ratio of 50% by promotion and 50% through LDCE. Under the said Rules, Primary
Teachers having completed at least five years of regular service were eligible for
consideration.
3. It is submitted that, vide amended Recruitment Rules dated 20.03.2025, the
ratio for filling up the post of Headmaster was revised to 66.67% by promotion
and 33.33% through LDCE. The applicants contend that the Recruitment Rules of
2012, 2018 and 2022 did not prescribe CTET qualification as an eligibility
condition for promotion to the post of Headmaster.
4. The applicants submit that CTET is required to be conducted twice a year.
However, after the examination conducted in November 2024, the next
examination was conducted by the CBSE only on 08.02.2026, and the results were

declared on 30.03.2026. It is stated that all the applicants appeared in the said
examination and successfully qualified the same.
5. It is further submitted that, vide circular dated 09.06.2026, the Respondent
KVS invited eligible employees to submit ten station preferences for promotion
from the post of PRT to that of Headmaster through the DPC against vacancies up
to December 2025. The online application process commenced on 09.06.2026 and
was scheduled to remain open until 12.06.2026. However, the applicants were
unable to submit their online applications as they had not qualified CTET in 2025.
As per the said circular, candidates having completed five years of regular service
as PRTs and qualified CTET Paper-I were required to submit their online
applications.
6. The applicants contend that, despite the CTET examination not having been
conducted during the relevant period in 2025, the Respondent Department insisted
upon the CTET qualification for consideration for promotion to the post of
Headmaster. Aggrieved by the action of the Respondents in denying them the
opportunity to submit their online applications for promotion through the DPC, the
applicants have approached this Tribunal by filing the present Original
Application.
7. The issue relating to consideration of eligible PRTs for promotion to the
post of Headmaster has already been considered by this Tribunal in O.A. No.
2265/2026, titled Anju Meena & Ors., decided on 07.09.2026. The applicants seek

consideration of their candidature in the light of the amended Recruitment Rules
and their subsequent acquisition of the CTET qualification.
8. The principal issue that arises for consideration is whether the applicants,
who had completed the prescribed length of regular service and subsequently
qualified CTET, can be permitted to participate in the selection process for
promotion to the post of Headmaster, subject to fulfilment of the other eligibility
conditions prescribed under the applicable Recruitment Rules.
9. Having regard to the view already taken by this Tribunal in O.A. No.
2265/2026, decided on 07.09.2026, the applicants seek a direction to the
Respondents to consider their candidature for promotion to the post of Headmaster
through the DPC, subject to verification of their eligibility in all other respects.
10. In the event the applicants secure the requisite merit position and are
otherwise found eligible, their candidature shall be considered for further stages of
the selection process in accordance with law.
11. The present OA is accordingly disposed of in the above terms. Pending
M.A(s), if any, also stand disposed of. No orders as to costs.
