1. At the outset, learned counsels for the parties submit that
the issue involved in the captioned matters are identical
and, therefore, the same can be heard and disposed of by
way of a common order. Accordingly, we have heard all the
matters and this common order is being passed.
2. At the outset, learned counsels for the respondents submit
that the respondents have complied with the directions of
the Tribunal and an affidavit(s) to this effect has also been
filed.
3. Mr. SK Gupta, learned counsel for the petitioners does not
dispute what has been submitted by the learned counsels
for the respondents but he submits that once the
respondents have considered and granted MACP benefits as
admissible under the MACP Scheme, they should have also
considered the petitioners for promotion as well inasmuch
as various juniors of the petitioners have been considered
and promoted during the interregnum. However, learned
counsel for the petitioners does not dispute that the factum

of the juniors having been promoted is not the subject
matter of the present litigation.
4. In this background, we are of the considered view that such
consideration of the petitioners’ request for promotion
cannot be gone into in the present proceedings.
5. In view of the aforesaid, the C.Ps. are closed and the notices
are discharged. However, the petitioners shall be at liberty
to agitate their surviving grievances, if any, including the
matter of their promotion, afresh in accordance with law.
Pending M.A., if any, stands disposed of.
6. There shall be no order as to costs.
7. The Registry is directed to place a copy this order in the
judicial files of all the C.Ps.
