CRM-M-43259-2026 (O&M) and connected case [2]
27.06.2026, registered at Police Station Sector 40, Gurugram,
under Sections 108 and 3(5) of the BNS.
2. For the reasons given in CRM-39416-2026 filed in
CRM-M-43259-2026, the same is allowed and legal submissions
and document Annexure R.1, are taken on record.
3. On 15.04.2026, one Ankit set himself on fire and
committed suicide. Before the said act of self immolation, he
recorded two videos alleging the present petitioners to be
responsible for the extreme step that he was taking.
3.1 His sister namely Deepa Yadav submitted a
complaint to the police on 21.04.2026, on the basis of which, the
present FIR was registered. The translated version of the same
(as given in Annexure P.1), is as under:-
“Sir, it is submitted that the complainant Deepa
Yadav, daughter of Late Mahesh Singh Yadav, is a
resident of village Sitapur, P.S. Thariaon, District
Fatehpur. The complainant has two other sisters, namely
Neha and her younger sister Deepika. The elder sister is
already married. I had a younger brother named Ankit
Kumar, who had been in a romantic relationship with
Kajal, daughter of Ram Singh, resident of Asothar Road,
P.S. Thariaon, District Fatehpur, for about 5 years. Kajal
used to live in Gurugram with the complainant's brother
and would also travel back and forth to the village with
him. About two years ago, Kajal was entrapped in a love
affair by Dilbagh Singh, resident of Karnal, Haryana, who
works as a contractor and was our father's boss. Kajal
also had another lover, Rikki Bhatt, resident of
Gurugram. Kajal, in collusion with her lovers Dilbagh
Singh and Rikki Bhatt, as part of a well-thought-out
conspiracy, falsely accused the complainant's brother
Ankit Kumar of theft and of extorting money from Kajal,

and threatened to have him sent to jail in a fabricated
case and to kill him, and demanded Rs. 5 lakh, and were
attempting to kill him. When the complainant's brother
came to Fatehpur on 15 August 2025, the aforesaid three
persons planned to kill the complainant's brother Ankit
Kumar, but they did not succeed. On 03/04 April 2026,
my brother came to the village, and on 07 April 2026,
when he was leaving the village by his own vehicle for
Gurugram, Kajal, her elder sister, and Kajal's brother
Kapil abused the complainant's brother and threatened to
kill him; and when we objected to this, they also abused
and threatened to kill all of us family members. For this
very reason, distressed by the persecution of the aforesaid
persons, my brother Ankit Kumar, on 15 April 2026 at
about 9 PM, in front of the Law College in Sector 40,
Gurugram, out of fear of the persecution by the aforesaid
persons, set himself on fire and committed suicide, for
which the aforesaid persons are responsible. The videos
and audios of this, which the complainant's brother had
sent to the complainant before committing suicide, along
with all the information, via phone and WhatsApp, are
available on the phones of the complainant and her
brother-Ankit. In Ankit Kumar's suicide videos, the clear
names of the aforesaid persons and the allegation of
harassment are proven. When the complainant came to
know of this, she went to AIIMS Hospital, Delhi, but by
then the complainant's brother had already died. A post-
mortem of the complainant's brother was conducted, and
on 18 April 2026, the body was brought to village Sitapur
and the last rites were performed. The entire incident is
known to the complainant as well as to her mother and
sisters, apart from the complainant herself. The
complainant submitted an application at P.S. Thariaon,
but no action was taken. Therefore, it is prayed to Your
Honour to kindly pass, orders for registration of the
complainant's report. Date: 21/04/26. Sd/- Deepa
Yadav.”

CRM-M-43259-2026 (O&M) and connected case [4]
4. Vide order dated 10.08.2026 passed in CRM-M-
43259-2026, the petitioner (Dilbag Singh) was directed to join
investigation. The operative part of the said order is as under:-
“Learned Senior counsel for the petitioner inter alia
submits that the petitioner has been falsely implicated.
He submits that the main grievance of the deceased Ankit
was against co-accused Kajal with whom he had been in
a romantic relationship but subsequently, relations
turned sour. It has been submitted that the FIR is vague
and even in the video alleged to have been recorded by
the deceased before he committed suicide does not show
any proximity of the allegations levelled against the
petitioner with that of commission of suicide by Ankit.
Learned Senior counsel submits that even if, for the sake
of arguments, the allegations are believed to be correct,
no offence under Section 108 of the BNS (306 IPC) is
made out. It has been submitted that the petitioner has
clean antecedents and is willing to join investigation and
abide by any condition imposed by the Court.
Notice of motion.
Mr. Amit Sahni, Addl. A.G, Haryana, accepts notice
on behalf of the respondent-State. Learned State counsel
submits that the allegations against the petitioner are
very serious and that custodial interrogation would be
required to elicit the truth.
A perusal of the FIR and the video which was duly
played in Court on the last date of hearing and today, a
transcript of the same has been produced, which has
been perused, shows that the main grievance of the
deceased was against Kajal and to some extent, her
brother. Though, it has been submitted that the petitioner
had been threatening the deceased and his sisters, there
does not appear to be any allegation of abetment of
suicide. The antecedents of the petitioner are stated to be
clean.
That being so, the petitioner is directed to join
investigation. In the event of arrest, he shall be released

on interim bail to the satisfaction of the
Arresting/Investigating Officer, subject to compliance of
the provisions of Section 482(2) BNSS.”
5. Similarly, vide order dated 24.08.2026 passed in
CRM-M-47179-2026, the petitioner (Kajal Devi) was directed to
join investigation. The operative part of the said order is as
under:-
“Learned Senior Counsel representing the petitioner
inter alia contends that even if, for the sake of arguments,
the allegations in the recording of the deceased are taken
to be correct, the ingredients of Section 306 are not made
out. Learned Senior Counsel further submits that at best,
it is a case of a relationship having gone sour. Learned
Senior Counsel further submits that the co-accused
Dilbag Singh had also sought anticipatory bail and vide
order dated 10.08.2026 passed by this Court in CRM-M-
43259-2026, interim protection has been granted to him.
Learned Senior Counsel further submits that the
petitioner has clean antecedents and is willing to join
investigation and abide by any condition imposed by the
Court.
Notice of motion.
Mr. Amit Sahni, Addl. Advocate General, Haryana
accepts notice on behalf of the respondent-State.
List on 07.09.2026.
To be heard along with CRM-M-43259-2026.
In the meantime, the petitioner is directed to join
investigation. In the event of arrest, she shall be released
on interim bail to the satisfaction of the
Arresting/Investigating Officer, subject to compliance of
the provisions of Section 482(2) BNSS.”
6. In compliance with the said orders, the petitioners
joined investigation. However, when the matters were listed for
arguments, the anticipatory bail petitions were opposed by

learned State counsel as also by learned counsel for the
complainant. Accordingly, detailed arguments were heard.
6.1 It was strenuously urged by learned Senior counsel
representing the petitioners that the petitioners have been
falsely implicated. He submitted that a bare perusal of the FIR
as also the videos uploaded by the deceased, makes it manifestly
clear that it is a case of a relationship having gone sour. It was
submitted that it was only because the petitioner (Kajal Devi)
had refused to marry the deceased and was allegedly in
relationship with the petitioner (Dlibag Singh) that Ankit took
the extreme step. It was submitted that by no stretch of
imagination can it be termed to be a case of abetment of suicide.
It was submitted that even if, for the sake of arguments, all
allegations levelled in the FIR are taken to be correct, no offence
punishable under Section 306 IPC is made out.
6.2 It was submitted that the antecedents of the
petitioners are clean; no recovery has to be made from them; the
case is based upon the allegations levelled in the FIR and legal
interpretation of the videos alleged to have been recorded by the
deceased; the petitioners have already joined investigation and
their custodial interrogation is not required. In support of his
contentions, learned Senior counsel relied upon the judgment of
the Apex Court in Yadwinder Singh @ Sunny Vs. State of
Punjab and another (SLP No. 7309-2025 decided on
27.10.2025) .
7. Per contra, learned State counsel and learned counsel
for the complainant, with equal vehemence, opposed the plea for

the grant of anticipatory bail. It was submitted that the gravity of
the allegations and the manner in which Ankit committed
suicide, disentitles the petitioners from seeking anticipatory bail.
Learned counsel for the complainant, while referring to the
WhatsApp chats between the complainant and Dilbag Singh and
also the videos uploaded by Ankit, made efforts to convince the
Court that it was on account of constant threats and
blackmailing that Ankit decided to take the extreme step. It was
submitted that in such a case, custodial interrogation would be
imperative to elicit the truth. In support of his contentions,
reliance was placed upon the judgments of Apex Court in
Chitresh Kumar Chopra Vs. State (Govt. of NCT of Delhi),
(2009)16 SCC 605; Gurbaksh Singh Sibbia etc. Vs. The State
of Punjab, (1980)2 SCC 565; Sushila Aggarwal and others Vs.
State (NCT of Delhi) and another, (2020)5 SCC 1 and Deepak
Aggarwal Vs. Balwani Singh and another, 2024 Law Finder
(SC) 3189.
8. I have considered the submissions made by learned
counsel for the parties.
9. Unfortunately, a young man committed suicide by
setting himself on fire. He uploaded two videos before taking the
extreme step. It is evident that he must be in an extremely
disturbed state of mind for, to every human being, life is very
dear. This Court went through the videos uploaded by the
deceased (duly annexed with the reply and played in Court as
well during the course of preliminary arguments), the transcript
of the same annexed with CRM-M-47179-2026 and the

WhatsApp chats between the complainant and Dilbag Singh,
placed on record by the complainant.
10. Prima-facie , it appears to be a case of a relationship
having gone sour. Whether the threats to implicate the deceased
and his sister in a criminal case can be termed to be a case of
abetment of suicide, would be determined when the trial
concludes. It would not be appropriate for this Court to delve
any further into the merits of the case lest it may prejudice the
case of either side. The petitioners have duly joined the
investigation under the orders of this Court. Their antecedents
are clean. No recovery has to be made from them. In the
considered opinion of this Court, no useful purpose would be
served by sending the petitioners into custody.
11. I have gone through the judgments relied upon by
both sides. In the case of Yadwinder Singh alias Sunny
(supra) , the Apex Court was examining the issue of quashing of
an FIR registered under Section 306 of the IPC. The said case
may not be relevant for the purpose of deciding the present
petition, for this Court is deciding the issue of grant of
anticipatory bail and at this stage, the merits are not required to
be gone into. In the judgments relied upon by learned counsel
for the complainant, Gurbaksh Singh Sibbia’s case (supra) and
Sushila Aggarwal’s case (supra) deal with the factors which are
required to be taken into consideration at the time of deciding a
petition for the grant of anticipatory bail. Both judgments are
celebrated judgments, not required to be quoted here. In
Chitresh Kumar Chopra’s case (supra) , the Apex Court was

dealing with a petition arising of framing of charges under
Section 306 IPC. The said judgment would also not be relevant
for the purpose of the decision of the present petition. In Deepak
Aggarwal’s case (supra), also guidelines were issued by the
Apex Court as regards decision of anticipatory bails. This Court
is duty bound to keep in mind the principles and guidelines laid
down by the Apex Court, while deciding a petition for the grant
of anticipatory bail. However, it has to be borne in mind that in
criminal cases, there can never be a strait jacket formula and
the concept of ‘one size fits all’ cannot be applied to criminal
proceedings. Each case has to be decided on its own peculiar
facts and only broad parameters as regards what can be termed
to be abetment and what cannot, can be laid down which, in the
present petitions for the grant of anticipatory bail, this Court
does not deem appropriate to venture into.
12. Keeping in view the totality of the facts and
circumstances, without expressing any opinion on the merits of
the case, the present petitions are allowed and the orders dated
10.08.2026 passed in CRM-M-43259-2026 and 24.08.2026
passed in CRM-M-47179-2026, are made absolute, subject to
compliance of the provisions as envisaged under Section 482(2)
BNSS.
A photo copy of this order be placed on the file of
connected case.
