Order On Board
02.11.2026
1. By way of the present petition, the petitioner has called in question
the inaction on the part of the respondent authorities in carrying

2
out demarcation of his land bearing Khasra No. 134/31,
admeasuring 0.020 hectare, situated at Patwari Halka No. 33,
Village Chantidih, District Bilaspur (C.G.), despite the fact that the
date for demarcation was fixed as 09.02.2026. The petitioner has
also raised a grievance regarding the failure of the respondent
authorities to take appropriate action on his complaints alleging
unauthorized occupation of the subject land.
2. The petitioners have approached this Court seeking following
appropriate reliefs :-
“ 10.1. Direct the respondent authorities, to conduct
demarcation of the petitioner's land bearing Khasra
No. 134/31, admeasuring 0.020 hectare (2160
square feet), situated at Patwari Halka No. 33,
Village Chantidih, District Bilaspur, Chhattisgarh,
within a stipulated period, in accordance with law;
10.2. Direct the concerned authorities to consider
the petitioner's complaints regarding the alleged
unauthorized occupation of the subject land and
take appropriate action in accordance with law;
10.3. Grant any other relief or reliefs which this
Hon'ble Court may deem fit and proper in the facts
and circumstances of the case, in the interest of
justice.”
3. Learned counsel appearing for the petitioner submits that despite
fixing 09.02.2026 as the date for demarcation of the petitioner's
land bearing Khasra No. 134/31, admeasuring 0.020 hectare,

3
situated at Patwari Halka No. 33, Village Chantidih, District
Bilaspur (C.G.), the respondent authorities have failed to carry out
the demarcation proceedings. He further submits that the
petitioner's complaints regarding alleged unauthorized occupation
of the subject land have also not received due consideration and
no effective action has been taken thereon. It is contended that
such inaction on the part of the respondent authorities adversely
affects the petitioner's right to hold and enjoy his property as
protected under Article 300-A of the Constitution of India. Learned
counsel submits that the petitioner is not seeking adjudication of
any disputed question of title but only seeks a direction to the
competent revenue authorities to conduct demarcation after giving
due notice to the concerned parties and to consider his complaints
and take appropriate action in accordance with law within a
stipulated time.
4. Learned State counsel, on instructions, submits that there
appears to be some dispute with regard to the subject land and,
therefore, the application for demarcation could not be decided
earlier. However, she submits that the respondent authorities shall
consider and decide the petitioner's application for demarcation
within a period of 60 days from the date of receipt of a copy of this
order, in accordance with law.
5. In view of the submission made by learned State counsel, the
present petition is disposed of with a direction to the respondent

4
authorities, particularly the competent revenue authority, to
consider and decide the petitioner's application for demarcation
within a period of 60 days from the date of receipt of a copy of this
order, after affording due opportunity of hearing to all concerned
parties.
6. It is made clear that this Court has not expressed any opinion on
the merits of the claim of the petitioner or the alleged unauthorized
occupation of the subject land. The competent authority shall take
an independent decision in accordance with law.
7. With the aforesaid direction, the petition stands disposed of.
