ORDER ON BOARD
30/10/2026
1. Applicant has preferred this application under Section 482 of Bhartiya
Nagrik Suraksha Sanhita, 2023 for grant of anticipatory bail as he
apprehends his arrest in connection with Crime No. 20/2026 registered at
Police Station- Mahila Police Station, District Janjgir-Champa (C.G.) for
the offence punishable under Sections 296, 115(2), 74, 332(b), 351(3),
3(5) of Bhartiya Nyaya Samhita, 2023 and Section 8 of POCSO Act.
2. Case of prosecution, in brief, is that on 25.07.2026, when the parents of
minor victim was were gone to attend some function, she was preparing
food with her younger sister at home, applicant/accused Ashok Kosle and
other co-accused persons allegedly arrived at her house, abused her
family members and threatened to kill her father. When the victim came
out of the house, the accused persons abused and threatened her and
her family, compelling her to retreat inside out of fear. Thereafter,
2 / 4
applicant allegedly entered the house, caught hold of her hand, dragged
her and pressed her neck against the wall. He also allegedly touched her
inappropriately on her chest and back and pulled her by her hair before
dragging her outside. Meanwhile, he held both her hands behind her
back, while co-accused Divya and Manisha allegedly abused and
assaulted her. Subsequently, the victim lodged a report against the
applicant and other accused persons at Women Police Station, Janjgir
based on which aforementioned crime was registered.
3. Learned counsel for the applicant would submit that applicant has been
falsely implicated only as a counter blast because applicant has lodged a
report in the concerned police station about causing damage to his tea
stall which he was running on the side of the road. The incident is dated
25.07.2026. After registeration of F.I.R. against complainant party, false
report has been submitted in the police station against applicant and his
family members on 29.07.2026, after about 4 days only to implicate the
applicant in grievous offence. Applicant has not committed any offence as
alleged. There is no criminal antecedent against applicant. Hence, he
may be enlarged on anticipatory bail.
4. On the other hand, learned State counsel opposes the submission of
counsel for applicant and would submit that as per allegation, applicant
along with Divya and Manisha Kosley entered into the house of
complainant, abused and assaulted the complainant and as per
allegation applicant has inappropriately touched the complainant. She
further submits that as per the observation made by this Court during
proceeding, case diary of Crime No. 231/2026 is also called for and
according to the F.I.R., complaint was lodged by Ashok Kosle (present
applicant) on 25.07.2026 thereafter investigation was done on
09.10.2026, statement has been recorded, nuksani panchnama has been
3 / 4
prepared and seizure is made from Kavita Kosley (complainant in instant
crime).
5. Pursuant to the notice issued on 23.09.2026, father of victim appeared
before this Court on 05.10.2026 and raised objection in grant of bail to
applicant.
6. I have heard learned counsel for the respective parties and also perused
the documents enclosed along with bail application.
7. On due consideration of the facts and circumstances of the case, nature
of allegation, submission of learned counsel for the parties, and further
considering the fact that report is lodged by applicant on 25.07.2026 of
the incident occurred on 25.07.2026 of causing damage of tea stall
wherein the report was lodged on 29.07.2026 making allegation of
commission of offence on 25.07.2026 and that there is no criminal
antecedent against applicant, without commenting anything on merits, I
am inclined to allow this anticipatory bail application.
8. Accordingly, application is allowed and it is directed that in the event of
arrest of applicant in connection with the crime in question (20/2026), he
shall be released on anticipatory bail by the Officer arresting him on his
executing a personal bond in the sum of ₹ 25,000/- with one surety in the
like sum to the satisfaction of the concerned arresting Officer. Applicant
shall also abide by the following conditions:

interrogation before the Investigation Officer as and when required;

inducement, threat or promise to any person acquainted with the facts
of the case so as to dissuade him/her from disclosing such facts to the
Court or to any police officer;

prejudicial to fair and expeditious trial; and
