Heard learned counsel of both sides.
[2] Mr. Tapash Datta Majumder, learned senior counsel submits
that a notification was issued by the State Election Commission on
30.10.2026 for the purpose of declaration of general election in respect of
Agartala Municipal Corporation and Municipal Councils of Dharmanagar,
Kailashahar, Kumarghat, Ambassa, Khowai, Teliamura, Ranirbazar,
Mohanpur, Bishalgarh, Melaghar, Udaipur, Santirbazar and Belonia and
Nagar Panchayats of Panisagar, Kamalpur, Jirania, Sonamura, Amarpur,
Sabroom and Bishramganj.
[3] It is the grievance of the petitioners that, particularly in Jirania,
Ranirbazar, Mohanpur, Santirbazar and Kamalpur, a fearful environment has
been created by certain miscreants led by the party in power and they are
also obstructing the intending candidates sponsored by petitioner No.1 for
which they are not being able to submit their nomination papers. In respect

of certain occurrence in Mohanpur, Kamalpur and Jirania, some FIRs have
also been lodged to the police.
[4] Mr. Majumder, learned senior counsel, referring to the
notification dated 30.10.2026, submits that the last date of submission of
nomination papers is 06.11.2026 (i.e., today), up to 3:00 p.m. Learned senior
counsel, therefore, presses for an order directing the police to make
adequate security arrangements so that the intending candidates may
submit their nomination papers smoothly to the respective Returning
Officers.
[5] Mr. Saktimoy Chakroborty, learned Advocate General
appearing for the respondent Nos.1 to 7, submits that whenever any FIR has
been submitted in the concerned police station, the police have taken proper
action and registered the cases. He further submits that the matter is not
now under the ceasing of the State Government, rather the Election
Commission is exercising control over the connected issues regarding
election process after issuance of the notification dated 30.10.2026 and said
election commission has not been notified yet. Learned Advocate General
also denies the allegations of any sort of physical assault or threat
administered upon any of the intending candidates of the petitioner No.1 as
alleged.
[6] Court has considered the submissions of both sides.
[7] It is a fact that the date of submission of nomination papers is
06.11.2026 (i.e., today). It is also the democratic right of the candidates to
contest in the election.
[8] Considering all these aspects, and the urgency of the situation,
this Court without making any observation on the merits of the petition,
directs the Director General of Police to make necessary arrangements for
adequate security and to ensure that the intending candidates sponsored by
petitioner No.1 are able to submit their nomination papers today without any
hindrance in the five concerned sub-divisions, i.e., Jirania, Ranirbazar,
Mohanpur, Shantirbazar and Kamalpur sub-divisions.

[9] Mr. Dipankar Sarma, learned Addl. G.A. is requested to
communicate this order verbally to the DGP, Tripura, immediately for
compliance.
[10] A copy of the order be furnished to the learned counsel of both
sides and copy of the order also be sent to the DGP without delay.
[11] As agreed by both sides, the writ petition is disposed of
accordingly in abovesaid terms.
