Order on Board
01/09/2026
1. The present petition is filled seeking following reliefs:-
10.1 That, this Hon'ble Court may kindly be pleased to
direct the respondent authorities to allow the
petitioners to file their candidature for the post of
Teacher (Agriculture) arising out of the advertisement
dated 28-07-2026 of Teacher (Annexure P-1) and
allow the petitioners to participate in selection process
for the post of Teacher (Agriculture).
10.2 That, this Hon'ble Court may kindly be pleased to
direct the respondent authorities to allow the
petitioners to complete their course of two years B.Ed.
degree during the course of their employment, if are
selected and appointed in the post of Teacher
(Agriculture).
10.3 That, this Hon'ble Court may kindly be pleased to
direct the respondent No.1 & 2 to make reference for
relaxation. to the respondent No.4 (National Council
for Teacher Education) under Clause-V of the
4 / 6
notification dated 12-11-2014 (Annexure P/6) for
providing relaxation to the petitioners pursuing two
years B.Ed. degree, so that the petitioners may
complete their B.Ed. degree during the course of their
employment, if selected in the selection process on
the post of Teacher (Agriculture) arising out of the
advertisement (Annexure P-1).
10.4 That, this Hon'ble Court may kindly be pleased to
direct the respondent authorities to take the decision
of the representations of the petitioners dated 04-08-
2026 (Annexure P-7).
10.5 That, the Hon'ble Court may kindly be pleased to
grant any othefr relief, as it may deems fit and
appropriate.
2. Learned counsel for the petitioners submits that the petitioners are
unemployed B.Sc. graduates pursuing a two-year B.Ed. course
and have already completed the first year thereof. He submits that
pursuant to the advertisement dated 28.07.2026 issued by the
respondents for appointment to the post of Teacher (Agriculture),
prescribing graduation with 50% marks and B.Ed. as the
educational qualification, the petitioners are otherwise eligible,
except that they are yet to complete the second year of the B.Ed.
course. It is therefore prayed that respondent No. 1 & 2 be
directed to make reference for relaxation to the respondent No. 4
i.e. National Council for Teacher Education under Clause V of the
notification dated 12.11.2014 for providing relaxation to the
5 / 6
petitioners pursuing two years B.ED degree so that the petitioners
may complete their B.Ed degree during the course of their
employment, if selected.
3. Learned State counsel, opposing the petition, submits that the
petitioners do not possess the requisite educational qualification
prescribed in the advertisement dated 28.07.2026, as they have
not yet completed the two-year B.Ed. course. It is submitted that
mere completion of the first year of the B.Ed. course does not
make the petitioners eligible for appointment to the post of
Teacher (Agriculture). The respondents cannot permit the
petitioners to participate in the selection process contrary to the
eligibility conditions prescribed in the advertisement. It is further
submitted that the petitioners cannot claim relaxation as a matter
of right and that any relaxation under Clause V of the notification
dated 12.11.2014 is subject to the competence and discretion of
the National Council for Teacher Education. In the absence of any
relaxation having been granted by the competent authority, the
respondents have no authority to treat the petitioners as eligible or
to permit them to participate in the selection process. Hence, no
interference is warranted at this stage.
4. I have heard learned counsel for the parties and perused the
records.
5. Perusal of the record shows that the relief sought by the
petitioners for making a reference to respondent No. 4, National
Council for Teacher Education, for relaxation cannot be granted at
this stage, as the petitioners have not made any representation
6 / 6
seeking such reference. Consequently, no such direction can be
issued by this Court.
6. However, keeping in view the future prospects of the petitioners,
who are students, the petition is disposed of with liberty to the
petitioners to make a representation before the competent
authority seeking a reference for relaxation in terms of Clause-V
of the Notification dated 12.11.2014. In the event such a
representation is made, the competent authority shall consider
and decide the same, in accordance with law, within a period of
30 days from the date of receipt of such representation.
7. With the aforesaid observation and direction, the writ petition
stands disposed of.
