Tahsildar, Adi Dravidar Welfare, Omalur, Salem District, under the
Government of Tamil Nadu. On 03.11.2025, he met with a road traffic accident
and was initially admitted to the Third Respondent Hospital through a 108
Ambulance at about 2.25 p.m. On the same day, he was shifted to Kauvery
Hospital, Salem – 20, where he underwent inpatient treatment from 03.11.2025
to 07.11.2025. Thereafter, he was re-admitted to the Third Respondent Hospital
on 07.11.2025, where he continued treatment until he unfortunately succumbed
to his injuries on 11.11.2025. An Accident Register was prepared, and an FIR
was subsequently registered in connection with the accident.
3. The Petitioner would submit that, as per G.O. Ms. No. 113, Finance
(Treasuries and Accounts-III) Department, dated 14.05.2025, a Personal
Accident Insurance cover of Rs.1 Crore is provided to eligible Government
employees in the event of accidental death or permanent disability, subject to
the applicable terms and conditions. Since her deceased husband was a
Government employee and maintained an SGSP Gold Account bearing
No.31290933443 with the State Bank of India, Omalur Branch, the Petitioner,
being his wife, submitted a Personal Accident Insurance claim application on
23.01.2026. The claim was registered under Claim
No.580000/48/2026/00112565.

dated 12.02.2026, 26.03.2026, 16.04.2026 and 05.05.2026, repeatedly requested
various medical records relating to her husband's treatment. The Petitioner duly
submitted the available documents on 02.03.2026, 30.03.2026 and 20.04.2026,
including the attested medical records, post-mortem report and treatment
summary.
5. The Petitioner would further submit that, pursuant to the Third
Respondent's repeated requests for the day-to-day inpatient treatment records
and death summary for the period from 07.11.2025 to 11.11.2025, she
submitted a representation dated 07.05.2026 to the Second Respondent Hospital
seeking the said records. However, by communication dated 11.05.2026, the
Second Respondent informed her that, as the case involved a medico-legal
death, the records could be furnished only upon receipt of a summons from the
competent Court, and that the treatment summary had already been issued on
05.01.2026.
6. The Petitioner would submit that she forwarded the said
communication to the Third Respondent through Registered Post on
27.05.2026. However, the Third Respondent, instead of processing the
insurance claim, once again issued an email dated 09.06.2026 insisting upon the
same hospital records.

WP No. 42065 of 2026
7. The Petitioner would submit that despite her repeated efforts and
submission of all available documents, her claim remains unprocessed to date.
Hence, the present Writ Petition has been filed seeking the reliefs stated supra.
8. Heard the learned counsel for the petitioner and the learned AGP for
the respondents 1 and 2.
9. The documents that the petitioner is seeking only relates to her
husband’s day-to-day inpatient records which are not confidential records or
classified ones. The documents are required so as to enable the petitioner to get
the insurance claim settled. Therefore, this Court directs the Second respondent
to furnish the relevant hospital treatment records, including the day-to day
Indoor Case Papers and Death Summary, relating to Late Mr.I.Balakrishnan for
the period 07.11.2025 to 11.11.2025 to the Petitioner, within a period of 3
weeks from the date of receipt of a copy of this order.
10. Accordingly, this writ petition is disposed of. No costs.
