2. Brief facts leading to filing of this appeal are as
follows:
The case of the prosecution is that accused No.1 is the
younger brother of CW.7. There is a dispute between
them in respect of front yard of the house of accused

of Gogi Police Station. On 01.12.2014 at about 05:00
p.m., CW.8 and his son CW.1 Mounesh S/o Mallappa
Pujari have cut the branches of a Neem tree which
was lying in front of their house and while cutting,
some of the branches of the Neem tree, fell on the
Curry leave tree which was lying in front of the house
of the accused persons and in respect of the same,
there was some verbal altercation between them. On

he was drinking tea in the house and his father was

about four years back, the police called him near canal

accused No.1 has produced one dagger and the police

Though in the examination-in-chief, he has deposed
that accused No.1 has produced one dagger, but
during the course of cross-examination, it is elicited
that Yamanappa has produced the dagger and the
police has not recorded the statement of Yamanappa

could be seen from the records, it appears that PW.2
is the habitual pancha. He has clearly admitted that
the police used to call him for any mahazar. The
evidence of PW.2 cannot be believed as he is a

she has deposed that about six years ago, accused
No.1 quarreled about cutting of tree and abused her
husband and accused No.2 held her husband and
accused No.1 stabbed on the stomach of her husband

number of criminal cases for drawing a mahazar.

CW.7 and his family members in filthy language and
intentionally insulted and thereby gave provocation
to CW.7 intending that such provocation would cause

to interfere with the impugned judgment of acquittal.
Accordingly, we answer point for consideration in the
Negative .
31. The scope of judicial interference in the case of
acquittal is very limited as held by the Hon'ble Apex
Court in the case of Jafarudheen and others vs.
1
State of Kerala , wherein the Hon'ble Apex Court held
at para 25 as follows:
“25. While dealing with an appeal against the
acquittal by invoking Section 378 of Cr.P.C., the
Appellate Court has to consider whether the Trial
Court's view can be termed as a possible one,
particularly when the evidence on record has been
analyzed. The reason is that an order of acquittal
adds up to the presumption of innocence in favour
of the accused. Thus, the Appellate Court has to be
relatively slow in reversing the order of Trial Court
rendering acquittal. Therefore, the presumption in
favour of the accused does not get weakened but
only strengthened. Such a double presumption that
enures in favour of the accused has to be disturbed
only through scrutiny on accepted legal
parameters.”
