The appellant has filed the present appeal under Section 2(1) of the
M.P. Uchcha Nyayalaya (Khand Nyayapeeth Ko Appeal) Adhiniyam, 2005
being aggrieved by the order dated 14.08.2026 whereby Writ Petition
No.31881/2026 has been dismissed by the Writ Court.
2. The facts of the case, in brief, are that the appellant/writ petitioner
was appointed as Gram Rojgar Sahayak (GRS) vide appointment order dated
28.06.2014. According to the appellant, he was falsely implicated in one
criminal case bearing Crime No. 232/2024, registered at Police Station
Sendari, District Niwari (M.P.), for the offences punishable under Sections

318(4) and 351(3) of the Bharatiya Nyaya Sanhita, 2023, on the complaint of
one Sangeeta Devi, allegedly at the instance of one Rakesh Bihari Pandey,
arising out of a land dispute between the family members of the appellant
and the said Rakesh Bihari Pandey.
3 . On account of the registration of the aforesaid criminal case,
Respondent No. 4, namely, the Chief Executive Officer, Zila Panchayat,
Niwari, vide order dated 22.07.2024, acting upon the circular dated
05.10.2023, directed that the appellant be kept away from the work and
duties of Gram Rojgar Sahayak until the completion of the enquiry. During
the said period, the appellant was also directed to be paid only 50% of his
remuneration.
4. Aggrieved by the aforesaid action, the appellant preferred Writ
Petition No. 22549/2024 before this Hon’ble Court, which was disposed of
vide order dated 12.08.2024, with a direction to the competent authority to
consider and decide the representation submitted by the appellant.
5. Thereafter, upon completion of the enquiry, the Enquiry Officer
submitted a report dated 13.06.2025, in which it was stated that the
complainant herself proposed the appellant as nominee and signed in the
Bank. Pursuant thereto, several representations were made by the appellant
for reinstatement into service, but no action was made by the
Respondent/Authorities.
6. Thereafter, the appellant again approached this Court by way of
filing Writ Petition No.5929/2026 which was disposed of vide order dated
17.02.2026, directing Respondent No. 4 to take an appropriate decision on

the basis of the enquiry report within a period of 90 days.
However, Respondent No. 4 failed to comply with the aforesaid direction
within the stipulated period, and the writ petitioner filed Contempt Petition
No.4016/2026 in which notices were issued on 24.06.2026, after issuance of
which, the Respondent No.4 maliciously passed order dated 30.07.2026,
terminating service of the writ petitioner and being aggrieved by the
aforesaid termination order, the writ petitioner preferred Writ Petition
No.31881/2026, which got dismissed vide order dated 14.08.2026. Hence,
the present writ appeal is filed before this Court.
Conclusion.
7. Looking to the facts of the case, the appellant/writ petitioner had
the remedy of appeal against the impugned order, but he chose to file the
writ petition, which has been dismissed. In the interest of justice, we hereby
permit the petitioner to avail the remedy of appeal before the Collector. In
case the appellant files an appeal, then the order passed by the Writ Court
dated 14.08.2026 in Writ Petition No.31881/2026 will not come in his way.

Respondent No.2-M.P. Rajya Rojgar Guarantee Parishad, Bhopal, are
