Mr. K.K. Joshi, learned counsel for the
petitioner.
2. Mr. Lalit Samant, learned counsel for
the respondents.
3. By the instant petition the petitioner is
praying for the following reliefs:-
“a. Issue a writ or order in the nature
of certiorari and thereby set
aside/quash the specific part of the
office order dated 28.09.2026 (not entire
office order) to the extent which orders
for deduction/recovery of an amount
of Rs.3,29,095/- from total admitted
gratuity amount of Rs.15,83,325/-
(Annexure-3 page No.18) of the writ
petition.
b. Issue a Direction or Writ in the
nature of Mandamus thereby direct the
respondent to pay the entire admitted
gratuity amount of Rs.15,83,325/- and
admitted leave encashment amount for
the three hundred days of leave which
petitioner accumulated for encashment
during his entire service with
prevailing bank interest.”

4. It is contended by learned counsel for
the petitioner that the issue as raised in this
petition is squarely covered by the judgment
of Division Bench dated 04.04.2024 passed in
bunch of Special Appeal leading one is
Special Appeal No.245 of 2022.
5. Mr. K.N. Joshi, learned Deputy
Advocate General for the State have not
disputed the aforesaid position.
6. In such view of the matter, the instant
petition is disposed of in terms of the order
of Division Bench dated 04.04.2024 passed in
bunch of Special Appeal leading one is
Special Appeal No.245 of 2022.
7. While disposing of this petition, the
respondents are directed to redress the
grievance of the petitioner in the light of the
aforesaid judgment within a month from the
date of production of certified copy of this
order.
