1. As common issues are involved in the captioned petitions, with
the consent of all sides, the same are hereby disposed of by this common
order. For the sake of brevity and convenience, facts are borrowed from
CWP No.27135 of 2018 .
2. The petitioner through instant petition under Articles 226/227
of the Constitution of India is seeking direction to respondents to grant
solatium and interest on solatium with respect to his land which was
acquired under National Highways Act, 1956.

3. On 23.12.2025, this Court passed the following order:
[1]. Lamently, in a large number of matters, it has been observed
that the grievance raised by the petitioners-landowners is about non-
payment of solatium, though the entitlement thereto is no longer res
integra.
[2]. Keeping in view the law laid down by the Hon’ble Supreme
Court in case of Union of India Vs. Tarsem Singh, Civil Appeal
No.7064 of 2019 decided on 19.09.2019 reported as ‘(2019) 9 SCC
304, it stands settled that the landowners whose lands have been
acquired under the National Highways Act, 1956 are entitled to
statutory solatium under Section 23(2) of the Land Acquisition Act,
1894.
[3]. It has further been noticed that continued non-disbursement of
such amounts, despite entitlement being undisputed, results in
unnecessary accrual of interest, thereby causing avoidable and
continuing financial burden upon the respondent-Authority.
[4]. With a view to streamline the process; facilitate expeditious
release of undisputed statutory dues to landowners, and to obviate
further accrual of interest liability on acquiring authority (NHAI),
this Court deems it appropriate to issue the following standardized
procedural directions in cases where the grievance is confined to
non-payment of solatium:-
I. The petitioner(s) shall file an affidavit before the
CALA stating specifically that:-
(a) Solatium under Section 23(2) has not been paid
to them till date;
(b) no award or supplementary award granting
solatium has been passed, or if any such award has
been passed, the same has not been challenged and or
is not under challenge before any court or forum; and
(c) no amount towards solatium has been received by
them, either directly/indirectly or in arbitration
proceedings.
II. Upon filing of such affidavit, the respondent-
Authority/CALA shall give opportunity of hearing to the

affected parties to verify the factual position and in case
CWP-27135-2018 & connected cases -6-
solatium has not been paid, the CALA shall take appropriate
steps for its release or deposit of the same in accordance with
law.
III. In the event the respondent-Authority/CALA asserts that
solatium has already been paid or that any award relating to
solatium is pending challenge, the relevant details shall be
placed on record by way of short affidavit.
[5]. This Court further deems it appropriate to prescribe a time-
bound schedule to ensure expeditious compliance. Accordingly, the
petitioner(s) shall filed the affidavit as directed above within a
period of 15 days from today. Upon filing of the said affidavit, the
respondent-Authority/CALA shall, within a further period of 15
days, verify the factual position and, where the entitlement of
solatium is found to be undisputed, calculations thereof shall be
forwarded to the concerned official of NHAI within a week.
Thereafter within two weeks of receipt of the calculations from the
CALA, the concerned official shall deposit the amount to the CALA.
Thereupon the CALA shall ensure the release of said amount to the
petitioner(s) within a further period of 15 days, in accordance with
law.
[6]. So far as the issue relating to payment of interest is
concerned, the same is kept open and is not being adjudicated at this
stage, especially in view of pendency of the review petition vide
Diary No.44096/2025 (filed on 07.08.2025) challenging the order
dated 04.02.2025 in M.A. No.1773/2021 in Civil Appeal
No.7064/2019 (Union of India & Anr. vs. Tarsem Singh & Ors.)
before the Hon’ble Supreme Court. Accordingly the present matters
are adjourned qua the said issue of interest.
[7]. List on 05.02.2025 for necessary compliance as well as qua
consideration upon interest entitlement.
[8]. It is clarified that the directions issued hereinabove pertain
only to the principal amount of solatium and shall operate
independently of the adjudication of the issue of interest.
[9]. A photocopy of this order be placed on the files of connected
cases.”

4. Learned counsel for the respondent-National Highways
Authority of India (for short ‘ NHAI ’) submit that NHAI is not disputing its
liability qua solatium and interest as upheld by Hon’ble Supreme Court in
National Highways Authority of India v. Tarsem Singh and others, 2025
SCC OnLine SC 235 and Union of India and another v. Tarsem Singh and
others, (2019) 9 SCC 304 . NHAI has already paid solatium in few cases and
in remaining cases, solatium along with interest would be paid within 2
months from the date of receipt of calculation from the Collector.
5. In the wake of statement of learned counsel for respondent-
NHAI, the petitions stand disposed of. The respondent-Land Acquisition
Collector shall calculate solatium and interest within two months from today
and intimate to NHAI which would release the payment within four weeks
from the date of receipt of the calculation. The petitioners, if feel aggrieved
from calculation, may avail their remedies as permissible by law.
6. Pending application(s), if any, shall stand disposed of.
