Heard learned counsel for the petitioner and learned
counsel for the State.
2. The complainant has filed this application for
quashing of the order dated 23.10.2024, passed by the learned
Principal Sessions Judge, Nawada, in Cr. Rev. No. 24/2024
arising out of Complaint Case No. 1520 of 2023, whereby
Criminal Revision petition was dismissed and the order dated
29.01.2024 was confirmed by which the learned Judicial

Magistrate-1st Class, Nawada dismissed the Complaint Case
No. 1520 of 2023 of the complainant for the offences punishable
under Sections 420, 467, 468 and 120(B) of the Indian Penal
Code.
3. As per the allegation, on 08.11.2023 at about 08:00
A.M, the complainant went to Primary Health Centre,
Nardiganj, who examined injured Naresh Singh and he asked
Dr. Suresh Kumar that why he made two types of injury report,
in first injury report, he mentioned simple injury cause by hard
blunt substance and on the same day he issued second injury
report of Naresh Singh both on 19.12.2021. It has further been
alleged that the complainant went to the concerned Officer In-
Charge, Sunil Kumar Singh, on the same day and he asked him
that why he issued two O.D. Slips, on which Officer-In-Charge
assaulted the complainant with fists and slaps. Thereafter, the
complainant went to concerned police station and narrated all
the incident, but Officer-In-Charge, Nardiganj Police Station,
could not register the F.I.R.
4. Learned counsel for the petitioners has submitted
that all the enquiry witnesses have supported the case of the
complainant, while the accused persons are police officers as
well as medical officers and they gave two types of injury

reports, while in one injury he mentioned same as simple caused
by hard and blunt object, and the second injury report was
provided for the same injury on 09.12.2021, by mentioning it as
simple caused by sharp cutting weapon. It has further been
submitted that the complainant inquired from the Officer
Incharge, the concerned police station regarding issuance of two
different O.D. slips, on which the said police officer assaulted
the complainant. It has, thus, been submitted that a clear case of
fraud is made out. Moreover, the impugned order dismissing the
complaint under Section 203 of the Cr.P.C. as well as the
revisional order of holding the same are bad in law and
erroneous of facts.
5. Learned counsel for the State opposed the prayer of
the petitioner.
6. Heard the parties and perused the records.
7. The Opposite Parties have discharged their official
duty. Moreover, no sanction has provided under Section 197 of
the Cr.P.C. and the variations, if any, as regards the nature of
weapons used and also be called in question, when the doctor as
well as the investigation officer of this case deposed themselves
as witnesses of the trial. Moreover the impugned order does not
required any interference.

8. Accordingly, the present application is dismissed.
