ORAL ORDER
Criminal Petition No.9316/2026 is filed to quash the
complaint and FIR dated 12.05.2026 in FIR No.0156/2026
registered before Periyapatna Town Police, Hunsur for the
offences under Section 126(2), 352, 115(2), 118(1),
351(2), read with Section 3(5) of the Bharatiya Nyaya
Sanhita, 2023 ('BNS').
2. The Criminal Petition No.14411/2026 is filed to
quash the charge sheet in C.C. No.910/2026 arising from
Crime No.154/2026 registered before Periyapatna Police.
3. The offences alleged are under Sections 126(2),
115(2), 118(2), 351(2), 352 read with Section 3(5) of
BNS.
4. Heard the learned counsel appearing for both
the petitioners in both the cases and the second
respondent/de-facto complainant in both the cases and
the learned High Court Government Pleader.

5. From the materials placed on record, it is
noticed that a civil dispute is pending in O.S. No.157/2025
on the file of Civil Judge, Periyapatna in respect of an
immovable property.
6. From the contents of the complaint and the
charge sheet materials it appears that a sudden scuffle
arose in the backdrop of the aforementioned civil case
pending between the parties.
7. The learned counsel for the petitioners in both
the cases and the learned counsel for the second
respondent victim, would submit that the petitioners do
not intend to prosecute criminal cases against each other
and they would agitate their grievance before the Civil
Court where the matter is pending.
8. It is the further submission that the injuries
allegedly sustained are minor injuries and no one is
admitted in hospital as in-patient and no one has suffered
any physical disability.

9. Since both the parties would submit that they
do not intend to prosecute the criminal case and they
would contest the civil dispute pending before the Civil
Court.
10. The Court considering the circumstances under
which the alleged scuffle has taken place and also
considering the fact that a civil dispute is pending between
the parties which might be the cause for the alleged
sudden unprovoked scuffle between the parties, is of the
view that the petitions have to be allowed and the
proceedings have to be quashed.
11. Hence, the following:
ORDER
(i) Petitions are allowed .
(ii) The proceedings in FIR No.0156/2026
registered before Periyapatna Town Police,
Hunsur and the proceedings in C.C.
