COMPTROLLER AND AUDITOR GENERAL OF INDIA
For Applicant(s) Advocate : Shri R.D.Meena
For Respondent(s) Advocate : Shri Manu Bhargava
Notes of The Registry Order of The Tribunal
The applicant was initially sent on deputation
vide order dated 29.07.2021 (Annexure A-4)
for a period of one year. The period of

accepts notice and waives service on behalf of
official respondents.
5. Learned counsel for the applicant states
that the impugned order dated 30.07.2026
(Annexure A-1), passed on his representation,
has not been passed by the Competent
Authority. According to learned counsel, in
terms of Clause 'c' of the Guidelines regarding
deputation of staff within the Indian Audit and
Accounts Department, the Director General
(Staff) is the Competent Authority in matters
relating to extension of deputation beyond five
years and up to seven years. In support of his
submission, learned counsel has placed
reliance upon Clause 'c' of the aforesaid
Guidelines, which reads as under:
"c. Deputation beyond 05 years upto 07 years on (+2
years) basis will be considered by DG (Staff) for
approval on case to case basis. A request for
extension of deputation beyond 05 years will be
entertained by the Competent Authority only if it is
forwarded along with NOC of the borrowing office, with
cogent reasons and at least three months prior to the
expiry of the period of deputation."
6. We have heard both the learned counsels
for the parties and carefully perused the
pleadings, materials and documents available
on record.
7. In our view, the above said clause 'c'
provides for consideration of extention of
deputation for a period beyond five years and
up to seven years by DG (Staff), which means
that in case the deputation is to be extended
beyond five years, then the same is required to
be considered by the DG (Staff). Hence, in
case, the deputation is not to be extended

beyond five years, there is no requirement of
any order or decision.
8. As such, the contention of the applicant that
the decision not to extend his deputation is
required to be considered by the DG (Staff) is
misplaced. The period of deputation has
automatically terminated on the date till which
the deputation was ordered. Therefore, no
formal order is required for non-extension of
the period of deputation.
9. Rather it is the other way round : if the
period of deputation is to be extended, then
only an affirmative act, i.e., a conscious
decision, is required to be taken. In the
present case, the period of deptutation of the
applicant automatically stood expired on
30.07.2026, the date till which the applicant's
deputation was ordered.
10. Besides, the guidelines which the
applicant has invoked relate to deputation
within the Indian Audit and Accounts
Department and, in the present case, the
applicant was on deputation from Indian Audit
and Accounts Department to State PWD /
State PHE. As such, otherwise also, these
guidelines are not applicable in the present
case.
11. It is also well settled that a deputationist
has no vested right to seek or claim extension
of deputation. Extension of deputation beyond
the sanctioned period depends upon the

decision of the competent authority and cannot
be claimed as a matter of right.
12. In view of the foregoing discussion, we
find no infirmity or illegality in the impugned
order dated 30.07.2026 warranting
interference by this Tribunal. The challenge
raised by the applicant is, therefore, devoid of
merit.
13. Accordingly, the present Original
Application stands dismissed with no order as
