ORAL ORDER
These petitions are filed seeking following reliefs:
In W.P.No.106257 of 2026
“a) Issue a Writ in the nature of Mandamus by directing
the Respondents to approve the Post of the Petitioner
who is working as “Attender” in the office of the
Respondent No.3 as per the Order dated 08-02-2024,
passed by this Hon’ble Court in Writ Petition
No.105215/2022 (S-REG) vide ANNEXURE-K, interest
of justice and equity.
b) Issue an appropriate direction by directing the
Respondent No.3 to approve the Post of the Petitioner
as “Attender” in the Office of the Respondent No.5
pursuant to the Order dated 10/3/2025 brg No.KPRC-
GPA/147/2024 passed by the Respondent No.4 vide
Annexure-M and the Recommendation dtd: 22/7/2025
brg No.PuSaUuKhu/Sibbandi/2025-26/522 along with
the List of Employees sent by the Respondent No.5 to
the Respondent No.3 vide ANNEXURE-N, in the
interest of justice and equity.
c) Issue such other suitable order/s or directions as this
Hon’ble Court deems fit and proper in the nature and
circumstances of the case, in the interest of justice
and equity.”

A) Issue a Writ in the nature of Mandamus by directing
the Respondent No.3 to approve the post of the
Petitioner who is working as “DATA ENTRY OPERATOR”
in the Office of the TMC, Ugarkhurd as per Order dated
8/2/2024 passed by this Hon’ble Court in Writ Petition
No.104975/2022 (S-RES) vide Annexure-K, interest of
justice and equity.
b) Issue an appropriate direction by directing the
RESPONDENT no.3 to approve the Post of the
Petitioner as “DATA ENTRY OPERATOR” in the Office of
the Respondent No.5 pursuant to the Order dtd:

10/3/2025 brg No.KPRC-GPA/147/2024 passed by the

list of Employees sent by the Respondent No.5 to the
Respondent no.3 vide ANNEXURE-N, in the interest of
justice and equity.
c) Issue such other suitable order/s or directions as this
Hon’ble Court deems fit and proper in the nature and
circumstances of the case, in the interest of justice
and equity.”
2. Heard learned counsel for parties in both petitions.
3. The learned counsel for the petitioners in both
petitions submits that on the earlier occasion this Court in
W.P.No.105215 of 2022 (S-REG) filed by the petitioner-Kareppa
Jangli and in W.P.No.104975 of 2022 filed by the petitioner-
Dayanand Kamble quashed the orders passed against the
respective petitioners directing the Zilla Panchayat, Belagavi to
approve the appointment of the petitioners in continuing in post
of Attender and Data Entry Operator respectively in the Town
Panchayat, Urag Khurd, Taluka-Kagawad.
4. The petitioners are before this Court seeking
regularization of their services. The learned counsel for the
petitioners invited the attention of this Court to Annexure-N
dated 22.07.2025, wherein the concerned Municipality has

forwarded the proposal for regularization of four other persons
on the premise that they are working since 15 to 20 years to
the concerned Chief Executive Officer, Zilla Panchayat,
Belagavi.

5. Sri Bhushan Kulkarni, learned counsel for the 3
respondent/Zilla Panchayat, Belagavi submits that in view of
Government Notification dated 25.06.2015, Ugar Khurd Gram
Panchayat has been upgraded as ‘Town Municipal Area’. The
authority is left with Deputy Commissioner and District Urban
Development Cell to take any action in respect of regularization
of service of the petitioners. However, Sri Bhushan Kulkarni,
learned counsel is not in dispute with the earlier orders passed
by this Court in respect of these petitioners, wherein this Court
has directed to continue the appointment by setting aside the
order of termination passed against the petitioners. It is also
not in dispute with reference to the observations of this Court
at paragraph No.2 in the order passed in W.P.No.105215 of
2022, wherein this Court has also observed that the Grama
Panchayath has been upgraded to Town Panchayath. If that be
so, the concerned Authority to forward the proposal to the to

the concerned Authority in terms of the earlier orders and the
proposal submitted as per Annexure-N, to the concerned
Deputy Commissioner and District Urban Development Cell for
taking necessary action at their end. In the event, the proposal
is sent to the concerned Deputy Commissioner and District
Urban Development Cell, the concerned Deputy Commissioner
and District Urban Development Cell to take proper action
keeping in mind the latest law laid down by the Hon'ble
Supreme Court in respect of regularization of service of
employees, who have served more than 10 years in which they
are engaged. Entire exercise shall be completed within a period
of 10 weeks from today.
6. The concerned authority to send the proposal to the
concerned Deputy Commissioner and District Urban
Development Cell within 3 weeks from today and the concerned
Deputy Commissioner and District Urban Development Cell to
consider the same within 7 weeks thereafter from today
keeping in mind the latest law laid down by the Hon’ble
Supreme Court and the Judgment of Division Bench of this
Court in W.A.No.100680 of 2025 disposed of on 16.10.2026
