COMMON ORDER
The petitioners are working as Salesmen and Supervisor,
respectively, in Shop No.7928 at Thiruvaiyaru, Thanjavur District. They
were transferred by order dated 09.01.2025. Aggrieved by the same, the
petitioners have filed these writ petitions.
2. The case of the petitioners is that the petitioner in W.P.
(MD)No.3343 of 2025, namely, Kodeeswaran, had lodged a complaint
against one Govindaraj before the District Manager, TASMAC,
Thanjavur. Therefore, the petitioners have been transferred to various

places at the instance of the 4 respondent, namely, Govindaraj. In the

typed set of papers, a copy of the complaint dated 28.08.2024 has also

been enclosed, which was affixed with the seal of the 3 respondent.
3. Therefore, this Court, being satisfied with the averments made
by the petitioners, has interfered with the order of transfer, by granting an
order of interim stay, on 05.02.2025 and directed the respondents to allow
the petitioners to continue in the same shop. Accordingly, the petitioners
have been allowed to continue in the same place.

4. In the counter affidavit by the 3 respondent, a stand has been
taken that there was no material for the receipt of the complaint dated
28.08.2024. Since the petitioners claim that the complaint was affixed

with the seal of the 3 respondent, this Court, by order dated 03.09.2026,
directed the first respondent to conduct an inquiry into the complaint
dated 28.08.2024.
5. Now, the first respondent has filed a report stating that they are
intending to conduct a transparent transfer counselling. This would
certainly resolve many problems in the TASMAC.

6. Placing appreciation to the first respondent Managing Director
for evolving a transparent transfer policy, this writ petition is disposed of
with liberty to the respondents to take a call during the transfer
counselling, instead of transferring a person on the ground of allegations.
The respondents shall ensure proper administration in the TASMAC
shops by installing CCTV cameras in all the shops and the same shall
also be monitored from the Regional Offices. No costs. Consequently,
connected miscellaneous petitions are closed. Consequently, connected
