Item 2/C-1 2 OA 1030/2026

O R D E R (ORAL)

On receiving advance copy of the O.A., Sh. Baljinder Singh
Khaira, learned counsel has put in appearance on behalf of the
respondents.
2. The present original application has been filed by the
applicant against the inaction of the respondents in not deciding
the representation dated 11.07.2026 (Annexure A-7) preferred by
the applicant.
3. The brief facts of the case are that the applicant, working as a
Clerk in the Engineering Department of the Chandigarh
Administration, submitted an application on 02.07.2025 seeking
out-of-turn government accommodation on medical grounds
following his father’s severe road accident and subsequent
emergency neurosurgeries. Despite a medical category vacancy
remaining unalloted during the House Allotment Committee (Lower)
meeting on 25.09.2025, the applicant’s case was left undecided.
Over the following months, the applicant pursued the matter
through multiple RTI applications, first appeal and CPGRAMS

applicant subsequently discovered that the vacant medical

submitted a detailed representation before the Secretary, House
Allotment Committee, Chandigarh Administration seeking
reconsideration of his application and examination of the procedure
adopted in making the allotment against the remaining medical
vacancy. However, the same has not been decided by the
respondents. Hence, the present OA.
4. Heard learned counsel for the applicant.
5. Issue notice to the respondents. Mr. Baljinder Singh Khaira,
learned counsel appears and accepts notice on behalf of the
respondents.
6. At this stage, learned counsel for the applicant submitted that
the applicant would be satisfied if a direction is given to the
Respondent No. 2 to consider and decide the applicant’s
representation dated 11.07.2026 (Annexure A-7) in a time bound
manner.
7. Learned counsel for respondents submitted that they have no
objection if the OA is disposed of in the manner suggested by
learned counsel for the applicant.
8. This Tribunal has considered the matter and is of the view
that natural justice will be met if Competent Authority, i.e.,
Respondent No. 2 is directed to decide the applicant’s

admission stage itself.
